Item No. 2 (continued)
Chief Building Official LaTorra presented the subject report. In response to
questions, Mr. LaTorra indicated that although recent efforts have been made
to correct the problems, the 30 -day period which would be allowed if the
resolution before Council is adopted would be insufficient, and suggested
continuance because of recent efforts to make corrections.
Mayor Claire declared the public hearing open at 8:08 p.m.
City Attorney Schricker asked that the Minutes reflect that the owner of the
subject property has identified himself as being present.
Jean Arambel, 1302 Katherine, described the work that is being done and
progress made in correcting the deficiencies, and stated that the basement is
no longer being used as living quarters and that work is expected to be
completed in 30 days.
Monique Arambel, owner, offered explanations as to why rehabilitation of the
property has been delayed.
M /S: Chandler /Stangel to continue the subject public hearing open for 30
days (until October 27, 1986).
Carried unanimously by voice vote.
MINUTE ORDER NO. 86 -181
----------------------------------------------------------------------------------
3. Public Hearing - Appeal of Notice of Noncompliance to
Franchise Tax Board, 3426 and 3466 Rolison Road -
Kenneth J. Graham, owner, appellant
Report: Chief Building Official and Community Development Director 9/8/86
Chief Building Official LaTorra presented the subject report. Mr. LaTorra
responded to questions by Council regarding the fact that inspection was made
shortly after the latest hearing (August 18, 1986) on the nuisance abatement
of the property, and they have not received a request for inspection since
that time.
City Attorney Schricker advised that if the Council affirms the Building
Official's recommendations, the Franchise Tax Board will disallow certain tax
deductions for the properties, and that once the property is brought into
compliance, the Franchise Tax Board would be so notified by the City and the
owner could then avail himself of deductions on a pro rata basis.
Mr. LaTorra noted that their concern is that the tenants have a safe
habitable place to live, and that the property has been in violation of City
ordinances for several years.
Mayor Claire declared the public hearing open at 8:30 p.m.
Reg.
