For the record, Mr. LaTorra advised that official notices <br />had been sent. <br />M /S: Greenalch /Chandler to close the public hearing. <br />Carried unanimously by voice vote, and public hearing closed at 8:31 p.m. <br />M /S: Greenalch /LaBerge to deny the appeal of Kenneth J. Graham, owner of the <br />rental properties at 3426 and 3466 Rolison Road, of notice of Noncompliance, <br />and to authorize the Chief Building Official to send the notice of Non- <br />compliance to the State Franchise Tax Board, and to include the following <br />findings: <br />1) that the condition of the buildings constitute a violation of State <br />and local provisions dealing with health, safety and building <br />requirements; <br />2) that the property has not been brought into compliance with those <br />code provisions within six months after date of notice given pursuant <br />to subdivision (b) of the Revenue and Taxation Code Section 17274; <br />3) that there have been no good faith efforts made for bringing the <br />buildings into compliance, nor have such efforts commenced with <br />respect to the property; <br />4) there is no good cause for extending the compliance date, in that the <br />amount of compliance evidenced has been minimal; <br />5) that the notice of Noncompliance in accordance with the Franchise Tax <br />Board requirements has been given to the owner; <br />6) that the property is not within the description of properties as <br />defined in subdivision (d) of Section 17274 of the Revenue and <br />Taxation Code, in that the property had not been rendered substandard <br />by conditions described in that subdivision, and the owner has not <br />secured financing and has not commenced work of repair, and in that <br />the property is not defined by subdivision (b) of Health and Safety <br />Code Section 35805 (owner- occupied residences of four or less units). <br />Carried unanimously by voice vote. <br />GENERAL <br />MINUTE ORDER NO. 86 -182 <br />Bill Rhodes, 1402 Valota Road, former Mayor and Councilmember, reported as the <br />City's representative to the South County Disposal District on the status of <br />dissolution of the District subsequent to the closing of the Marsh Road dump in <br />Menlo Park some time ago.
