Item No. 3 (continued) <br />Ken Kaufman, South Bayside System Authority, explained the standard that <br />determines the violation. He explained that the standards are 4.5 milligram <br />per liter for copper and 0.6 for lead. He said that some of the tests have <br />shown copper to be 18 milligrams per liter which is nearly 4 times the <br />allowable limit and lead at 1.7 which is 3 times the limit. <br />At the request of the City Attorney, Mr. Kaufman described the process SBSA <br />follows in detecting the violations and the period of time involved, noting <br />the staff report outlines the sequence followed for Bay Area Circuits. He <br />noted that samples were collected last week and there were no violations but <br />there must be a minimum of 3 to 6 months with no violations to demonstrate <br />compliance, depending on frequency of collecting samples. He advised that <br />the cost involved in sampling is $200 per sample. <br />Mayor Claire opened the public hearing at 9:20 p.m. <br />Roy Nobriga, 91 Winslow, representative of Bay Area Circuits, stated that <br />since October 24 of this year they have been in compliance and submitted <br />analysis reports from two different labs for file. <br />Boon Lim, consultant for Bay Area Circuits, 1211 Park Avenue, San Jose, <br />explained that his company installed another system in October and a month <br />later installed a more sophisticated system and that they check the system <br />often and make recommendations for any repairs that need to be done. <br />In response to questions from City Attorney, Mr. Nobriga and Mr. Lim <br />explained that the equipment installed in November is permanent and all <br />automatic; that the company does electroplating, that the old equipment could <br />not handle the new chemical the company now uses; that they are sure the new <br />system will work but if it doesn't, there is another system that is <br />guaranteed 100 %. <br />M /S: Britschgi /Bury to close the public hearing. The public hearing closed <br />at 9:30 p.m. <br />At request of Council, City Attorney Schricker repeated the four options <br />available to Council. (See above) <br />Mr. Bewley (see above) stated that SBSA is not recommending immediate <br />termination at this time and suggested 90 day extention and to continue <br />sampling 2 -4 times a month on a random basis and report back to Council. <br />M /S: LaBerge /Chandler to rescind the motion to close the public hearing and <br />continue the public hearing re Notice of Intention to Terminate Sanitary <br />Sewerage Services - Bay Area Circuits, 91 Winslow Street, open for 90 days; <br />that the South Bayside System Authority continue monitoring and report back <br />to Council, and that the cost of the monitoring be borne by Bay Area <br />Circuits. <br />Carried unanimously by voice vote.
