Oral Communications (continued) <br />1. Judy Buchan, 1126 Allerton Street, and secretary of the Mezes Neighborhood <br />Association, described their frustration with the judicial system under which <br />the owners of Whipple Lodge, defendants in a civil case involving allegations <br />of numerous violations, had been given a continuance in the case to May 14. <br />They recognized that the City had done what it can and the situation has <br />improved, but asked what further avenues can be pursued. <br />Council discussion followed, and in response to question, City Attorney <br />Schricker suggested that information and pressure should be directed to the <br />District Attorney's Office, which has jurisdiction over the case. It was <br />also suggested by Council that the group present might present their <br />complaints before the Board of Supervisors; and that there is a legal process <br />which applies equally to everyone. <br />2. James Kreaqer, 1485 Veterans Boulevard, expressed concern and asked for <br />Council support of his position regarding the proposal to install train gates <br />and overhead gantry at Veterans Boulevard and Chestnut required by the Public <br />Utilities Commission as part of the improvements of Veterans Boulevard, and <br />advised of his contacts with State legislators regarding the proposal. <br />Public Works Director Addiego stated that the P.U.C. had imposed the <br />requirement and agreed that the installation was an unnecessary expense; that <br />in the event future train traffic increases from the Port on the <br />Chestnut Street tracks, then would be the appropriate time to install the <br />gates. <br />City Manager Smith indicated that the staff stands ready to support an appeal <br />to the P.U.C. in the matter. <br />---------------------------------------------------------------------------------- <br />(Council recessed from 9:18 to 9:30 p.m.) <br />4. Public Hearing - Resolution of Intention of the <br />Planning Commission initiating proceedings for adoption <br />of Specific Plan - 701 Marine World Parkway (203 -07) <br />Planning Commission record transmitted 4/24/85 <br />Affidavit of Publication of Notice of Hearing on file <br />Planning Director Schroeter presented a synopsis of the subject record. <br />Discussion followed and Mr. Schroeter commented and replied to questions by <br />Council and pointed out that the Specific Plan is less definitive than a <br />planned development permit, and would have to be followed by at least a <br />development agreement; and although when it reaches that stage in the <br />process, a planned development permit may or may not be required, that in the <br />event it is, he recommended that a condition should be incorporated in the <br />Specific Plan itself recognizing the fact that the parking level should not <br />exceed that which has been approved for other developments; that traffic <br />control should be anticipated as necessary here as in other parts of Redwood <br />Reg.
