Public Hearing - Appeal of the denial by the Zoning Administrator of <br />Applications for Architectural and Use Permits for rehabilitation of <br />building located at 2306 El Camino Real - La Casa Legal for Pat Ryan, <br />appellant (203 -10) <br />Report of City Manager and Planning Director 12/22/83 <br />La Casa Legal Appeal letter of Michael Adams for Pat Ryan 12/9/83 <br />City Attorney Schricker reviewed action taken by the City and in the <br />Courts relating to the subject appeal since the City Council abatement <br />of nuisance order was made regarding the building. <br />Planning Director Schroeter reported that the appeal is related to <br />applications for Architectural and Use Permits which were denied but <br />that he understands that Pat Ryan, owner of the building, expects to <br />make another submittal of plans which may be approvable. He observed <br />that the appeal remains before Council at this time. <br />Mayor Stangel declared the public hearing open at 8:50 p.m. <br />Michael Adams, attorney representing Pat Ryan, owner of the subject property, <br />stated that Mr. Ryan now has plans to upgrade the building by using the <br />ground floor for a restaurant and the upper floor for office space with an <br />inside stairwell, provided he can obtain the financing needed to do so. <br />The permit applications being appealed are for a plan to use the ground <br />floor for a restaurant and the second level for residences with an outside <br />staircase as existed before the fire and abatement order, except that he <br />will convert the ground floor from a bar to a restaurant. The plan being <br />appealed would be constructed, if Mr. Ryan cannot obtain the financing to <br />do the upgraded construction, but Mr. Adams said his client is proceeding <br />with the appeal in order to have options, depending upon the financing <br />available. <br />In response to questions of City Attorney Schricker, Mr. Adams said that <br />he estimated value of the subject building before the fire was between <br />$50,000 and $100,000; that the anticipated cost of reconstruction to abate <br />the nuisance and meet Building and Fire Code requirements, and provide for <br />a restaurant on the ground floor, residences above and outside staircase <br />would be $87,000; and that to reconstruct the building with a ground floor <br />restaurant, offices on the second floor and an inside staircase would cost <br />$109,000. <br />Reg.Mtg. <br />1/9/84 <br />Page 5 <br />MINUTE BOOK NO. 44 <br />Page No. 318 <br />
