Lener to Pat Webb, City of Redwood City <br />Re: Addendum to the EIR on the Downtown Mixed-Use Project <br />May 3 I, 2002 <br />Page 3 <br /> <br />Task 3. Prepare Addendum <br /> <br />It is our current thinking that an Addendum is the appropriate CEQA document to address either <br />Project 1 or Project 2. Task 3 includes the work scope elements involved in preparing an <br />Addendum. If, when the administrative draft Addendum has been prepared and presented for <br />review, it is determined that the use of an Addendum is not justified, we will submit an adjusted <br />scope of work, budget, and schedule to complete CEQA review in some other appropriate form. <br /> <br />Steps in preparing the Addendum to the EIR would include: <br /> <br />· Prepare background materials for the Addendum (maps, project description, explanation of <br /> the reason for preparing an Addendum, other background materials). <br /> Note: <br /> <br /> CEQA (Guidelines Section 15164) provides for preparation of an Addendum to a previously <br /> certified EIR if none of the conditions that would call for preparation of a subsequent EIR <br /> (Guidelines Section15162 (a)) have occurred. A brief explanation of the decision not to <br /> prepare a subsequent EIR, supported by substantial evidence, is to be included either in the <br /> Addendum or in the lead agency's findings or elsewhere in the-record. <br /> <br /> We propose to draft the explanation of the decision to prepare an Addendum. If we are <br /> authorized to proceed with Project 2, the decision to proceed with an Addendum would be <br /> supported by (1) completion of an environmental checklist documenting a conclusion that <br /> the substitution of a hotel use for the alternatives previously considered would not introduce <br /> new environmental impacts or result in effects substantially more severe than was the case <br /> for alternatives previously considered, and (2) a preliminary transportation analysis by our <br /> transportation subcontractor of the hotel on Block 2, sufficient to demonstrate that the <br /> impacts envelope defined by the earlier project and alternatives analysis "brackets" the <br /> impacts of the hotel use. <br /> <br /> In either case - Project 1 or Project 2 - we understand that stuff witl arrange for review by <br /> City Attorney or legal counsel, or both, to assure that the decision to prepare an Addendum <br /> is appropriate and legally defensible. We will consult with start to determine whether the <br /> decision to prepare an Addendum is best presented in the Addendum proper, in the findings, <br /> in a staff report, or elsewhere, as part of the public record for the project. <br /> <br />· Summarize the technical reports in a format and at a level appropriate to the Addendum. <br /> <br />· Verify that mitigation measures required under the Downtown Mixed-Use/Retail Project <br /> EIR are either included in the project or reflected in City conditions of approval. <br /> <br />· Complete an administrative draft of the Addendum and, upon receipt of comments from staff <br /> and applicant representatives, complete document for review and acceptance by the City. <br /> <br /> <br />
