Mr. Schricker said that if the appellant <br />understands and wishes to withdraw his appeal, the $100.00 appeal fee can be <br />returned. <br /> <br />Mayor Stangel declared the public hearings open at 8:20 p.m., stating that <br />all testimony will be considered to be addressed to the combined public <br />hearings. <br /> <br />City Clerk Hildebrand reported the Affidavits of Publication of Notice of <br />Hearing and of Mailing are on file and that the notice requirements are <br />identical for both public hearings. <br /> <br />Jack V. Denton, 330 Turks Head Lane, appellant, stated he understands the <br />situation and that he concurs in the proposed zoning change from "PO" to <br />"R-2", although he objec ts to the use of the site by the Coopera tive. Mr. <br />Denton stated that he does not want to take any action which might jeopardize <br />his legal position with regard to the appeal and requested a recess in order <br />to consult his attorney. <br /> <br />(Council recessed from 8:25 to 8:40 p.m.) <br /> <br />Mr. Denton reported that his attorney is a member of Redwood Shores <br />Homeowners Associa tion and has asked that the appeal remain in the rec ord and <br />tha t no re fund of his appeal fee be made. <br /> <br />Mr. Denton continued, saying that his principal objection to the proposed <br />ordinance is the change from "PO" to "CB" which allows building heights which <br />he believes would be excessive for a transit ion area. He sta ted that he <br />believes Redwood Shores, Inc., the applicant, is in general agreement with <br />him and that adequate zoning can be permitted which is satisfactory to all. <br /> <br />Mike Gibson, Redwood Shores, Inc., 350 Marine World Parkway, reported that <br />when the application was reactivated, it was decided that provision should be <br />made for professional and business offices and some retail with housing <br />inc luded consistent with the cone ep t plan pre sen ted to the Planning <br />Commission. Mr. Gibson pointed out that the "CB" District meets the <br />requirement, and that his company would be willing to accept a 35 ft. height <br />limit, saying there is no fundamental disagreement with Mr. Denton. <br /> <br />Discussion followed and Mr. Schroeter, Mr. Schricker, Mr. Denton and Mr. <br />Gibson commented and replied to questions concerning permitted uses in zoning <br />districts; the fact that the residents have previously complained about lack <br />of gas stations and convenience stores in Redwood Shores; whether they want <br />such development now; and the possibilities presently available to Council in <br />considering the subjec t application. <br /> <br />Darryl Foreman, member of the Coop era tive Board of Direc tors, stated he <br />supported the proposed zone change from "PO" to "R-2". <br /> <br />Mayor Stangel invited anyone else present who wished to speak to do so. <br />one wished to speak. <br /> <br />No <br /> <br />MIS: BritschgilMosher to close the public hearing. <br />Carried unanimously and public hearing closed at 9: 10 p.m. <br /> <br />Title read. MIS: Rhodes/Britschgi to uphold the Planning Commission and <br />grant the application of Redwood Shores, Inc. to amend the Zoning Map to <br />rezone property from "PO" Distr ic t to "R-2" Distr ic t and to reverse the <br />Planning Commission and deny the application to amend the Zoning Map to <br />rezone the re st of the property from "CB" and "PO" and "R-2" Distr ic t to "CP" <br />District and from "PO" to "CB" District; and to approve the ordinance for <br />first reading.
