<br />delegation shall not be effective untj1 accepted by SBSA in writing. Upon the written <br /> <br />concurrence of SBSA, the responsibility for enforcement may be delegated to City or <br /> <br />may be assumed by the District, as SBSA shall specify. District shall compensate SBSA <br /> <br />or City, as the case may be, for all costs and expenses incurred by SBSA or City, <br /> <br />respectively, in providing such enforcement. Subject to the foregoing concurrence of <br /> <br />SBSA, should District assume responsibility for the enforcement of said Uniform <br /> <br />Ordinances, any failure by District to enforce, shall constitute a material breach of this <br /> <br />Agreement by District. <br /> <br />District shall not discharge or permit to be <br /> <br />9. PROHIBITED DISCHARGES. <br /> <br />discharged either directly or indirectly into City Facilities or SBSA Facilities any sewage <br /> <br />or other matter which is prohibited by the Uniform Ordinances, or which otherwise <br /> <br />threatens to cause, or will cause damage or injury to persons; to City Facilities; to SBSA <br /> <br />Facilities; or the real or personal property of third persons and entities. District hereby <br /> <br />grants to SBSA and City the power to take all necessary action to cease or terminate any <br /> <br />such discharges. This grant of power to SBSA shall not be effective until accepted by <br /> <br />SBSA in writing. District shall notify City immediately upon ascertaining that sewage <br /> <br />has been deposited in District Facilities or City Facilities in violation of the Uniform <br /> <br />Ordinances. Such notification shall not relieve or absolve District from liability in any <br /> <br />manner whatever which may result by reason of such prohibited discharges. <br /> <br />10. HOLD HARMLESS. <br /> <br />3.
