(4) (5) Fences. Paving. (6) Necessary maintenance of existing structures not including any structural alteration or reconstruction. (b) Subsequent to the adoption of plan lines for a street right of way, building setback requirements and yard requirements shall be measured from the exterior lines of the plan lines. (c) Notwithstanding the provisions of subdivision (a) and (b), above, the Council may permit buildings and structures to be constructed or altered within a plan line area, or within the setback or yard area measured from a plan line for a street right of way, if the Council finds that the application of this section would otherwise result in the substantial impairment of the prop- erty rights of a property owner affected by the plan lines. Ap- proval for such construction or alteration shall be given by resolution. SECTION 47.12 Term of Effectiveness. In the event pro- ceedings are not initiated to acquire the property for which plan lines are adopted, or some portion of such property, within four years after the plan lines are adopted, the plan lines shall have no further effect for purposes of Section 47.11, but shall be advisory only. The provisions of this section shall not be con- strued to preclude the re-initiation of plan line proceedings for the same general location during or subsequent to the expiration of such four year period. SECTION 47.13 Abandonment. Any official plan line may be abandoned by resolution of the Council without notice or hearing. No such resolution shall be adopted, however, until the Planning Commission has had an opportunity to report its recommendations on each abandonment. The abandonment shall be effective immed- iately or on such specific date as may be prescribed by the resolution. The resolution of abandonment shall be recorded and filed in the same manner as resolutions adopting plan lines. SECTION 47.14 plan Lines Continued. (a) All plan lines adopted pursuant to the provisions of Section 31.1, et seq., of Ordinance No. 600 shall be continued in full force and effect for the period prescribed in Section 31.12 of Ordinance No. 600. (b) All plan lines adopted by the City subsequent to May 1, 1960, and prior to June 21, 1962, shall be continued in effect for a period of four years from the date of adoption, or until June 21, 1965, whichever is longest. Plan lines continued in effect pursuant to this section shall have no effect after the dates specified in this section unless re-established pursuant to the procedures set forth in this ordinance. 87
