<br />(4) <br />(5) <br /> <br />Fences. <br /> <br />Paving. <br /> <br />(6) <br /> <br />Necessary maintenance of existing structures not <br />including any structural alteration or reconstruction. <br /> <br />(b) Subsequent to the adoption of plan lines for a street <br />right of way, building setback requirements and yard requirements <br />shall be measured from the exterior lines of the plan lines. <br /> <br />(c) Notwithstanding the provisions of subdivision (a) and <br />(b), above, the Council may permit buildings and structures to <br />be constructed or altered within a plan line area, or within the <br />setback or yard area measured from a plan line for a street right <br />of way, if the Council finds that the application of this section <br />would otherwise result in the substantial impairment of the prop- <br />erty rights of a property owner affected by the plan lines. Ap- <br />proval for such construction or alteration shall be given by <br />resolution. <br /> <br />SECTION 47.12 Term of Effectiveness. In the event pro- <br />ceedings are not initiated to acquire the property for which plan <br />lines are adopted, or some portion of such property, within four <br />years after the plan lines are adopted, the plan lines shall have <br />no further effect for purposes of Section 47.11, but shall be <br />advisory only. The provisions of this section shall not be con- <br />strued to preclude the re-initiation of plan line proceedings for <br />the same general location during or subsequent to the expiration <br />of such four year period. <br /> <br />SECTION 47.13 Abandonment. Any official plan line may be <br />abandoned by resolution of the Council without notice or hearing. <br />No such resolution shall be adopted, however, until the Planning <br />Commission has had an opportunity to report its recommendations <br />on each abandonment. The abandonment shall be effective immed- <br />iately or on such specific date as may be prescribed by the <br />resolution. The resolution of abandonment shall be recorded <br />and filed in the same manner as resolutions adopting plan lines. <br /> <br />SECTION 47.14 plan Lines Continued. (a) All plan lines <br />adopted pursuant to the provisions of Section 31.1, et seq., of <br />Ordinance No. 600 shall be continued in full force and effect <br />for the period prescribed in Section 31.12 of Ordinance No. 600. <br /> <br />(b) All plan lines adopted by the City subsequent to May 1, <br />1960, and prior to June 21, 1962, shall be continued in effect <br />for a period of four years from the date of adoption, or until <br />June 21, 1965, whichever is longest. Plan lines continued in <br />effect pursuant to this section shall have no effect after the <br />dates specified in this section unless re-established pursuant to <br />the procedures set forth in this ordinance. <br /> <br />87 <br />
