<br />ARTICLE 50 <br /> <br />ENFORCEMENT <br /> <br />SECTION 50.1 Enforcement. (a) Responsibility for the <br />enforcement of this ordinance shall be with the Planning Director. <br />All officials, employees and departments of the City shall assist <br />the Planning Director and shall issue no permit, certificate or <br />license for any use, building, structure, or purpose in conflict <br />with the provisions of this ordinance. <br /> <br />(b) It shall be the responsibility of the Building Inspector <br />to enforce the provisions of this ordinance in connection with the <br />issuance of permits for the erection, construction, moving, altera- <br />tion or reconstruction of any building or structure. <br /> <br />(c) Every permit, certificate or license issued by any <br />official, employee or department of the City in conflict with <br />the provisions of this ordinance shall be null and void. <br /> <br />SECTION 50.2 violation a Public Nuisance. Any building <br />or structure set up, erected, constructed, altered, enlarged, <br />converted, moved or maintained contrary to the provisions of this <br />ordinance, and any use of land, building, or premise established, <br />conducted, operated or maintained contrary to the provisions of <br />this ordinance, shall be and the same is hereby declared to be <br />unlawful and a public nuisance. <br /> <br />SECTION 50.3 Duty of City Attorney. The City Attorney <br />of the City shall, upon order of the Council, immediately commence <br />action or proceedings for the abatement and removal and enjoinment <br />of any violation of this ordinance, in the manner provided by <br />law, and shall take such other steps and shall apply to such <br />courts as may have jurisdiction to grant such relief as will <br />abate and remove such building or structure and restrain and <br />enjoin any person, firm or corporation from setting up, erecting, <br />building, maintaining, or using any such building or structure <br />or using property contrary to the provisions of this ordinance. <br /> <br />SECTION 50.4 Remedies Cumulative. The remedies provided <br />for herein shall be cumulative and not exclusive. <br /> <br />SECTION 50.5 Violation a Misdemeanor. Any person, firm <br />or corporation whether as principal, agent, employee, or otherwise, <br />violating or causing the violating of any of the provisions of <br />this ordinance shall be guilty of a misdemeanor and, upon con- <br />viction thereof, shall be punishable by a fine of not more than <br />Five Hundred Dollars ($500.00), or by imprisonment in the county <br />jail for a term not exceeding six months, or by both such fine <br />and imprisonment. <br /> <br />SECTION 50.6 Each Day a Separate Offense. Each day during <br />any portion of which any violation of this ordinance is committed <br />or continued by such person, firm or corporation, shall constitute <br />a separate offense and shall be punishable as herein provided. <br /> <br />90 <br />
