1 10.) To hold STATE, its officers and employees, harmless <br />2 from any claim or claims alleged to have resulted from lack of an <br />3 adequate outfall system or from any change in existing drainage <br /> ,patterns due to construction of the facilities referred to in <br />6 <br />? SECTION III <br />8 SAN CARLOS AGREES: <br />9 1.) To deposit with STATE within 30 days of receipt of <br />10 billing therefor (which billing will be forwarded immediately <br />11 following STATE's bid advertising date of a construction contract <br />12 for the aforesaid I~PROVEMENTS), the amount of $43,900, which <br />13 figure represents STATE's estimate of SAN CARLOS's share of the <br />1~ construction cost required to complete the said I~PROVE~NTS afte~ <br />15 deducting the Federal-Aid Urban funds applied towards the <br />16 construction cost pursuant to this Agreement. Actual cost to be <br />17 borne by SAN CARLOS will be determined upon completion of all work <br />18 and shall be 12.16 percent of the total matching fund towards the <br />19 construction cost for completing the said IMPROVEMENTS including <br />20 traffic stripes and pavement markings, STATE-furnished materials, <br />21 and any extra or additional work directly related to the said <br /> <br />22 IMPROVEMENTS. .. <br /> <br />23 2.) In the event that the construction cost to SAN CARLOS <br />2~ to be computed at the time of bid opening does not exceed the <br />25 present estimated amount of $43,900 by more than 10 percent STATE <br /> -11- <br /> <br /> <br />
