If, however, said <br />2 mstimated construction cost of $43,900 is exceeded by more than 10 <br />3 ~ercent STATE shall consult with SAN CARLOS and upon written <br />~ :onsent of SAN CARLOS to assume the additional 'cost and deposit <br />5 ~f additional funds upon billing by STATE, STATE may award the <br />6 ~foresaid contract. <br />? 3.) To maintain all existing facilities and the portion of <br />S the said I~{PROVE~ENTS constructed within SAN CARLOS's right of <br />9 l~aY including any additi°nal right of way relinquished bYSTATE <br />10 I~o SAN CARLOS upon completion of the project; and to maintain the <br />11 ~2 canary island pines located along Skyway Road just north of <br />12 4nnte Vista Road; and make no claim against STATE for any <br />13 ~ortion of such maintenance expense. <br />1~ 4.) Upon the adoption, filing and recording of the <br />15 ~esolution of Relinquishment by the California Transportation <br />16 2ommission, to accept that portion of right of way with roadway <br />17 ;hewn in green on attached Exhibit A together with all appurtenant <br />18 drainage facilities as relinquished by STATE pursuant to this <br />19 Agreement. <br />20 5.) To dedicate to COUNTY avigation easements as shown on <br />21 ~xhibit C. <br />22 6.)
