1 to REDWOOD CITY, SAN CARLOS, or COUNTY under this Agreement. <br />2 4.) That, should STATE receive Federal reimbursement for <br />3 this project of more than 83 percent of construction and right <br />~ of way costs, all of said Federal reimbursement over and above <br />5 83 percent of construction and r~ght of way costs shall be <br />6 apportioned to REDWOOD CITY, SAN CARLOS and COUNTY in the same <br />? proportion as their respective shares of the matching funds. <br />8 5.) That, should the said Federal reimbursement to STATE <br />9 for this project be less than 83 percent of construction and <br />10 right of way costs, REDWOOD CITY, SAN CARLOS and COUNTY shall <br />11 reimburse STATE the difference between 85 percent of the <br />12 construction and right of way costs and the actual Federal <br />13 reimbursements, said difference to be alloted in the same <br />114 proportion as their respective shares of the matching funds. <br />15 6.) That, in the construction of said work, STATE will <br />16 furnish a representative to perform the usual functions of a <br />17 Resident Engineer, and REDWOOD CITY, SAN CARLOS and COUNTY each <br />18 may, at no cost to STATE, furnish a representative, if they so <br />19 desire, and that said representatives and Resident Engineer will <br />20 cooperate and consult with each other, but the order of STATE's <br />21 engineer shall be final. <br />~2 7.) That, should SLATE incur any additional expense on <br />23 behalf of either REDWOOD CITY, SAN CARLOS, or COUNTY pursuant to <br />2~ construction of the IMPROVEMENTS referred to herein which is not <br />25 specifically defi~ed under provisions set forth in this Agreemen' <br /> -16- <br /> <br /> <br />
