4/25/2005 <br />Monitoring: The Courthouse reconstruction plans and construction drawings <br />(the "Plans ") have been modified to reflect the requirements specified in Appendix D of <br />the FEIR and comply with these Standards. Staff will document their implementation in <br />a report to the Planning Commission. <br />Findings: As supported by substantial evidence in the record, the <br />implementation of the Project will override the loss of the South Annex historical <br />resource since the Courthouse reconstruction project will restore the original facade to <br />the Courthouse. In addition, in conformance with the Standards, the open space created <br />by the removal of the South Annex will also result in the restoration of the (pre- Annex) <br />spatial relationship of the reconstructed Courthouse with the Theater (both properties <br />are listed on the National Register). This return to the historically established "Period of <br />Significance" (1910 -1938) identified in the EIR complies with the Standards. Finally, the <br />Project will serve as a catalyst for the economic development of the downtown. <br />Overriding Considerations: The environmental, economic, social and other <br />benefits of the Project override the significant impact described above, as more fully <br />stated in the Statement of Overriding Considerations in section 3 of the Resolution. <br />B) Light Fixtures <br />Potential Impact: The Plans, pages A3.6 and A3.7, note 9, reference the <br />"relocated and refurbished light fixtures from South Annex ". It appears that the light <br />fixture was original to the 1910 Courthouse and used on the South Annex with an <br />altered light globe. Additional research will be conducted to confirm whether re -use of <br />the fixtures can occur. If the fixtures are determined to be not authentic, their inclusion <br />into the Plans would cause a potential impact because of its non - compliance to the <br />Standards. <br />Mitigation: The following mitigation measure, as set forth in the FEIR, is hereby <br />adopted and will be implemented as provided in the mitigation monitoring and reporting <br />effort: <br />Additional research should be conducted to confirm authenticity of the <br />subject light fixtures to insure compliance with the Standards. If <br />determined to be authentic, no additional mitigation measure is needed. If <br />determined not to be authentic, the light fixtures should not be installed <br />and the note to refurbish and install these fixtures removed from the <br />Plans, in compliance with the Standards. <br />Monitoring: Prior to City Council consideration of the Project, additional <br />research was conducted and documented, and the authenticity of a major portion of the <br />light fixtures has been confirmed. Although the majority of the fixtures are authentic, <br />archival photographic records have confirmed that the upper portion of these fixtures <br />needs to be modified to include a "globe design ".
