All Appeals shall be filed with the City Clerk within 10
days from the date of determination to pay relocation costs pursuant to the
Relocation Ordinance. The process for Appeals shall be as follows:

a.

Upon receipt of Notice from the Housing & Redevelopment Director,
the property owner shall file a written statement within 10 days of the
date of determination advising the City Clerk that the right to appeal
is being exercised. The property owner shall also provide copies of the
appeals statement to the Housing and Redevelopment Director, the
Building Official, and the City Attorney.

b.

The appeals statement shall contain all grounds for the appeal,
including specific reasons why the property owner believes that the
Building Official's determination that affected tenants must be
relocated is inappropriate in the case of the subject property being
abated.

c.

Upon review of the Appeal, if the City Attorney finds that the appeal
should be heard by the City Council, the City Attorney will direct the
Housing and Redevelopment Division to suspend relocation action and
will cause the Appeal to be presented to the City Council for a final
decision.

The City Clerk shall set the appeals for hearing within thirty (30) days.
of the date of filing the appeal and shall give written notice of said
hearing to the Appellant, the Director, the owner, the Developer and
to any person requesting notice of such appeal. At the hearing on the
appeal, the Council shall hear the appellant, the Director, the owner,
the Developer (if applicable) and such other person or persons as the
Council deems appropriate under the circumstances. Upon conclusion
of the hearing, the Council may affirm, revise, or modify the
determination of the Director. The decision of the Council shall be
final.

8
