<br />4. <br /> <br />APPEALS PROCESS <br /> <br />A property owner, Developer, tenant or former tenant who receives Notice <br />(Exhibit V), or other interested person of an affected property, regarding <br />obligation to pay relocation costs pursuant to Ordinance # 2048 shall have the <br />right to appeal. All Appeals shall be filed with the City Clerk within 10 <br />days from the date of determination to pay relocation costs pursuant to the <br />Relocation Ordinance. The process for Appeals shall be as follows: <br /> <br />a. <br /> <br />Upon receipt of Notice from the Housing & Redevelopment Director, <br />the property owner shall file a written statement within 10 days of the <br />date of determination advising the City Clerk that the right to appeal <br />is being exercised. The property owner shall also provide copies of the <br />appeals statement to the Housing and Redevelopment Director, the <br />Building Official, and the City Attorney. <br /> <br />b. <br /> <br />The appeals statement shall contain all grounds for the appeal, <br />including specific reasons why the property owner believes that the <br />Building Official's determination that affected tenants must be <br />relocated is inappropriate in the case of the subject property being <br />abated. <br /> <br />c. <br /> <br />Upon review of the Appeal, if the City Attorney finds that the appeal <br />should be heard by the City Council, the City Attorney will direct the <br />Housing and Redevelopment Division to suspend relocation action and <br />will cause the Appeal to be presented to the City Council for a final <br />decision. <br /> <br />The City Clerk shall set the appeals for hearing within thirty (30) days. <br />of the date of filing the appeal and shall give written notice of said <br />hearing to the Appellant, the Director, the owner, the Developer and <br />to any person requesting notice of such appeal. At the hearing on the <br />appeal, the Council shall hear the appellant, the Director, the owner, <br />the Developer (if applicable) and such other person or persons as the <br />Council deems appropriate under the circumstances. Upon conclusion <br />of the hearing, the Council may affirm, revise, or modify the <br />determination of the Director. The decision of the Council shall be <br />final. <br /> <br />8 <br /> <br />
