<br />2.3.8 Coordination of Technical Inspection and Testinq. CM/GC shall coordinate all testing <br />and inspection. If requested, CM/GC shall assist City/Agency in selecting any special <br />consultants or testing laboratories. <br /> <br />2.3.9 Safety Proqrams. CM/GC shall implement site safety programs and conduct appropriate <br />safety meetings. CM/GC is not responsible for Trade Contractors' means and methods of <br />construction. Neither the professional activities of CM/GC, nor the presence of CM/GC's <br />employees or sub-consultants at the Project site, shall relieve the Trade Contractors of their <br />obligations, duties and responsibilities including, but not limited to, construction means, <br />methods, sequence, techniques or procedures necessary for performing, superintending and <br />coordinating the Work in accordance with the Contract Documents and any health or safety <br />precautions required by any regulatory agencies, applicable law, or the standard of care. <br /> <br />2.3.10 Construction Observation. CM/GC shall observe the Work to see that the materials and <br />equipment being incorporated into the Work are handled, stored and installed properly and <br />adequately and are in compliance with the Contract Documents for the Project. CM/GC shall <br />report to City/Agency regarding the status of such activity. CM/GC shall endeavor to guard <br />against defects and deficiencies and shall advise City/Agency of any deviations, defects or <br />deficiencies that CM/GC observes in the Work. CM/GC's observation duties shall include <br /> <br />reasonable diligence to discover work that is not in compliance with the Contract Documents. <br /> <br />2.3.11 Non-Conforminq Work. CM/GC shall promptly inform City/Agency in writing of defective <br />or non-conforming Work performed by the Trade Contractors, and shall make recommendations <br />to City/Agency, Architect and City/Agency inspector in instances where CM/GC observes work <br />that, in its opinion, is defective or not in conformance with the Contract Documents. CM/GC <br />shall observe the Trade Contractors' work to verify that all corrective measures and authorized <br />changes are properly incorporated in the Project. CM/GC shall report to City/Agency regarding <br />the status of such activity and provide a written record of the same. <br /> <br />2.3.12 Exercise of Contract Riqhts. CM/GC shall exercise its rights under the Trade Contracts, <br />such as giving the Trade Contractors notice to accelerate the progress when the schedule goals <br />are in jeopardy, withholding payment for cause and other prerogatives when required in an <br />effort to achieve contract compliance. <br /> <br />Atty/Agr/2005.003 <br />030805/L.
