<br />liability of the policy, and that if City, its Council, officers, <br />boards, commissions, agents, and employees have other <br />insurance against a loss covered by such a policy, such <br />other insurance shall be excess insurance only. <br /> <br />6. Assignments. <br /> <br />This Permit and the duties, rights, and privileges <br /> <br />granted to Permittee hereunder may not be assigned by Permittee without the <br /> <br />prior written permission of the City Manager and subject to approval of the <br /> <br />assignment as to form by the City Attorney; provided, that no such assignment <br /> <br />shall be made which would allow or permit a use of the Encroachment Area <br /> <br />inconsistent with this Permit. <br /> <br />7. Compliance With Laws. Permittee shall not do or permit anything to <br /> <br />be done in, on, or about the Encroachment Area, or bring or keep anything in, <br /> <br />on, or about the Encroachment Area, which will in any way conflict with any law, <br /> <br />statute, ordinance, or governmental rule or regulation now in force or which may <br /> <br />hereafter be enacted or promulgated by any public authority. <br /> <br />8. Signs. Permittee shall not place any signs upon the Encroachment <br /> <br />Area. <br /> <br />9. <br /> <br />Aba ndonmentlRevocatio n. <br /> <br />In the event that Permittee, or its <br /> <br />permitted assignees hereunder, abandons or fails to use the Encroachment <br /> <br />Area, or shall fail, neglect, or refuse to maintain the Encroachment Area in a neat <br /> <br />and attractive condition, or to comply with any of the terms and/or conditions <br /> <br />herein contained, or causes, in whole or in part, radio or other means of <br /> <br />Agmt-287 <br />f:\sh \sh/Redwood\Cou ncil <br />FXS:rg <br />09/07/99 <br /> <br />4 <br />
