<br />1-30-19982:51PM <br /> <br />FROM ALTA BUSINESS SVCS 650 349 5862 <br /> <br />P.5 <br /> <br />neat, clean and sanir.ary condition, free from waste and debris <br />and shall neither commit waste nor permit any waste or nuisance <br />thereon. <br /> <br />Sublessee shall not install, maintain, use or allow in <br />or upon the Premises any pinball machine, coin operated music <br />machine or other coin operated device of any kind or character <br />and Sublessee, upon request of Sublessor, shall immediately <br />remove any such device which in the opinion of r.he Sublessor is <br />objectionable, offensive, or not in good taste, and if Sublessee <br />shall fail to do so, Sublessor may re-enter the Premises and <br />remove the same at the expense of Sublessee. <br /> <br />9. <br /> <br />CONDITION OF PREMISES. <br /> <br />Omitted. <br /> <br />10. ~r,'rERATIONS AND REPAIRS. Sublessee shall make no <br />additions, alterations, changes or improvements in the Premises, <br />or any part thereof without the consent of Sublessor first <br />obtained in writ:ing upon plans conforming to all governmenr.al <br />regulations. Any and all work shall be performed pursuant to a <br />written contract by a licensed, bondable general contractor in <br />such a manner as shall not interfere, inconvenience or constitute <br />a nuisance to other tenants. Sublessee agrees ~o give Sublessor <br />written notice of the commencement date of any alterations, <br />improvements or repairs to be made in, or upon the Premises not <br />later than fifteen (lS) days prior to the commencement of any <br />such work, in order to give Sublessor the time to (1) post: notice <br />of nonresponsibility, or (2) require Sublessee to take other <br />action to pror.ect Sublessor's interest. Sublessee shall keep the <br />premises free of any liens or encumbrances - Prior to <br />commencement of any work of improvement for alterations, <br />additions, changes or repairs to the Premises which could <br />conceivable result in a claim for a mechanics' lien being filed <br />on the property owned by Lessor or in the interest held by <br />Sublessor, Sublessee shall file in the office of the County <br />Recorder where the Premises are located, every original contract <br />entered into by Sublessee or Sublessee's agents together with a <br />payment bond (as defined in Section 3096 of the California Civil <br />Code) with each original contractor as principal in t:he minimum <br />amount of 50% of each original contract price. The Sublessor <br />shall pay towards the premiums for such payment bonds, 1% of the <br />amount of the bond; t:he Sublessee shall pay all premiums J.n <br />excess of ~hat paid by Sublessor. Sublessee waives all rights to <br />make repairs at Sublessor's expense under the provisions of <br />Section 1941 and 1942 of the Civil Code or California.
