<br />j :F'L CP <br /> <br />CONSISTENCY WITH <br />CONSER V ANCY'S <br />INTERlM GUID ELJNES : <br /> <br />Section 31400.1 of the Public Resources Code allows the Con- <br />servancy to award grants to any public agency or nonprofit or- <br />ganization for accessways that serve more than local public <br />needs. The proposed projects, all of which will fund public <br />agencies, will serve more than local needs because the Bay <br />Trail is intended ultimately to serve members of the public <br />from allover the Bay Area and beyond. <br /> <br />Under Section 31400.2 of the Public Resources Code the Con- <br />servancy may provide up to the total cost of initial acquisition <br />and development of public accessways by any nonprofit or- <br />ganization or public agency and, under Section 31400.3, the <br />Conservancy may provide such further assistance as is required <br />to aid public agencies and nonprofit organizations in estab- <br />lishing a system of public coastal accessways and related func- <br />tions. The Novato project is to fund the design of the Hamilton <br />Field Bay Trail alignment, and the Sausalito, Hunter's Point, <br />Redwood City, Palo Alto, Alameda, Benicia, and Martinez <br />projects are to provide additional assistance to those agencies <br />to appraise and survey, design, and construct the Bay Trail <br />elements proposed. <br /> <br />All of the projects recommended for funding met the Access <br />Program Guidelines and Access Standards that were in effect <br />during the grant application period. The proposed projects are <br />also in compliance with the recently adopted interim guide- <br />lines, as indicated below. <br /> <br />Promotion of the Conservancy's Statutory Programs: As <br />discussed in the preceding section, the proposed projects are <br />consistent with the Conservancy's enabling legislation regard- . <br />ing the Public Access Program. In addition, the construction <br />projects are consistent with the Access Program Standards, as <br />follows: The projects in Hunter's Point, Redwood City, Palo <br />Alto, Alameda, and Benicia will be constructed on alignments <br />that safely accommodate public use (Standard No. I) and will <br />be constructed to prevent impacts to sensitive resources (Stan- <br />dard No.5). <br /> <br />Consistency With Purposes of the Funding Source: The <br />funds proposed to be used for these projects come from an ap- <br />propriation from the state General Fund, which was designated <br />for coastal access projects under then-Governor Wilson's <br />Coastal Initiative. <br /> <br />ID-I0 <br />
