<br />~ ~~<6 <br /> <br />COMPLIANCE <br />WITH CEQA: <br /> <br />Several of the proposed projects are exempt from review under <br />the California Environmental Quality Act (Public Resources <br />Code Sections 21000 et seq.), as follows: <br /> <br />Sausalito Project: Surveys and Appraisals Are Not "Projects". <br />The City of Sausalito will use its funding to have property sur- <br />veyed and appraised. For purposes of CEQA, the preparation of <br />pre-acquisition analyses are not "projects" as defined in Title <br />14, California Code of Regulations ("14 CCR"), Section 15378 <br />because they do not have the potential to result in either a direct <br />physical change in the environment or a reasonably foreseeable <br />indirect change in the environment. Thus, the City of Sausa- <br />lito's proposal does not constitute a "project" under CEQA. . <br /> <br />Novato and Martinez Projects: Feasibilitv and Planning Studies <br />are Exempt. Projects involving only feasibility or planning <br />studies for possible future actions which the agency, board, or <br />commission has not approved, adopted, or funded are statuto- <br />rily exempt under 14 CCR Section 15262. Staff has determined <br />that the Novato project is exempt under this section because the <br />City of Novato proposes only a planning study of various <br />alignments of the Bay Trail through Hamilton Field and the de- <br />velopment of a trail plan. Staff has also determined that the <br />Martinez project is exempt under this section because the City <br />of Martinez proposes only a planning study of alternative <br />alignments of the Bay Trail through the Martinez Regional <br />Shoreline Park and the preliminary design of a pedestrian and <br />bicycle bridge. <br /> <br />Redwood City, Alameda.. Benicia, and Hunters Point Projects: . <br />Exempt as Minor Alternations to Land. Minor public or private <br />alterations in the condition of land, water, and/or vegetation <br />which do not require the removal of healthy, mature, scenic <br />trees are categorically exempt from CEQA review under 14 <br />CCR Section 15304. <br /> <br />The Redwood City project will construct a narrow, 10-foot- <br />wide decomposed granite trail on an existing levy which will <br />only involve clearing and grubbing, minor grading, erosion <br />control, and the installation of fences, where no trees will be <br />removed. Staff has thus determined this project to be exempt as <br />a minor alteration to land. <br /> <br />The City of Alameda's project is to construct a small concrete <br />path, which will also involve only minor clearing, grubbing, <br />and grading, and will not require the removal of healthy, ma- <br /> <br />ill-12 <br />
