<br />'1f,4 <br /> <br />Development Department of the City and all information and/or submittals <br />requested by the City at that time have been provided by the Church, then: <br /> <br />a) <br /> <br />the term of this Temporary Use Permit shall be extended to twenty one <br />(21) months from the Issue Date ("First Extended Expiration Date"); and <br /> <br />b) <br /> <br />the Church shall continue to respond to all reasonable and necessary <br />requests of the City in conjunction with preparation of the MOU Specific <br />Plan; provided, that if the Church does not respond to such requests, this <br />Temporary Use Permit shall expire on the Base Expiration Date. <br /> <br />22.5 If, upon the Assessment Date, the MOU Specific Plan has not been adopted, <br />but all requests for information and submittals made by the City have been <br />responded to or provided by the Church, but the MOU Specific Plan is not <br />under active review by the City, then: <br /> <br />a) <br /> <br />the term of this Temporary Use Permit shall automatically be extended to <br />the First Extended Expiration Date; <br /> <br />b) <br /> <br />the Church may prepare and submit to the City for processing a Specific <br />Plan (the "Church Specific Plan") which may forego designating any land <br />use changes, but which shall contain other necessary or desirable <br />design or planning provisions; provided, that such provisions shall not <br />necessitate preparation of an Environmental Impact Report; and <br /> <br />c) <br /> <br />this Temporary Use Permit shall expire upon the First Extended <br />Expiration Date; provided, that if the Church does not respond to the <br />City's reasonable and necessary requests for information and/or <br />submittals, this Temporary Use Permit shall expire on the Base <br />Expiration Date. <br /> <br />22.6 If this Temporary Use Permit is extended pursuant to the provisions of <br />paragraph 22.4 above, but the City does not approve and adopt the MOU <br />Specific Plan on or before the First Extended Expiration Date, then <br /> <br />Fullyalive-rsoa <br />f/sh/sh/RC/ComDev <br />06/01/00 <br /> <br />a) <br /> <br />the term of this Temporary Use Permit shall automatically be extended <br />and shall expire twenty seven (27) months after the Issue Date (the <br />"Second Extended Expiration Date"); <br /> <br />b) <br /> <br />irrespective of whether the MOU Specific Plan is under active review by <br />the City, the Church may, at its election, prepare and submit for <br />processing the Church Specific Plan for approval and adoption by the <br />City Council; and <br /> <br />c) <br /> <br />this Temporary Use Permit shall expire upon the Second Extended <br />Expiration Date. <br /> <br />"-"""'~1Ir <br />
