adequate and appropriate evidentiary basis for the findings and actions set forth in this <br />Resolution. <br />Section 2. CEQA: The Planning Commission finds that the project is exempt from <br />the California Environmental Quality Act (CEQA), pursuant to Sections 15301 "Existing <br />Facilities" and 15331 "Historical Resources Restoration/Rehabilitation" because: <br />a. As required by CEQA Guidelines Sections 15301(e)(2) (Existing Facilities), <br />the project is comprised of an addition of less than 10,000, is located in an <br />area where all public services and facilities are available to allow for <br />maximum development permissible in the General Plan of the CEQA <br />Guidelines, and is located in an area which is not environmentally sensitive; <br />and <br />b. As set forth in CEQA Guidelines section 15331, Historical Resource <br />Restoration/Rehabilitation, the proposed Project involves the maintenance, <br />repair, rehabilitation, restoration, preservation, conservation or <br />reconstruction of historical resources in a manner that is consistent with the <br />Secretary of the Interior's Standards for the Treatment of Historic Properties <br />with Guidelines for Preserving, Rehabilitating, Restoring, and <br />Reconstructing Historic Buildings, and the proposed project has been found <br />not to impact the eligibility of the resources for listing in the California <br />Register, as discussed in the CEQA Exemption Determination Memo. <br />Section 3. Downtown Planned Community Permit DPC2016-004: The Planning <br />Commission finds that: <br />a. The Project and improvements proposed by Downtown Planned <br />Community permit DPC2016-004 are consistent with, conform to the intent <br />of, and will appropriately implement the Downtown Precise Plan for the 929 <br />Main Street project; and <br />b. The establishment, maintenance and operation of the project and <br />improvements proposed by Downtown Planned Community permit <br />DPC2016-004 will not, under the circumstances of this particular case, be <br />detrimental to the health, safety, peace, morals, or general welfare of <br />persons residing or working in the neighborhood of the project, or be <br />detrimental or injurious to property or improvements in the neighborhood of <br />the project, or to the general welfare of the City, because the project has <br />been found to be consistent with the community goals established in the <br />City's General Plan and Zoning Ordinance; and <br />c. The Project and improvements comply fully with all applicable Standards of <br />the DTPP, with the exception of the Main Street sidewalk width. Because of <br />the adjacent historic building and Expanded Historic Main Street District, <br />the Planning Manager has exempted the requirement pursuant to Section <br />2.4.2(A)1.b ; and <br />d. The Project and improvements comply with all but two (2) Guidelines of the <br />DTPP.
