Ord. were granted to <br /> permit construction of a residence at 3737 Laurel Way, likewise upon the <br /> condition that the property owner enter into an agreement to improve Laurel Way <br /> to a width of one-half standard hi�lside street specifications across the frontage of <br /> said property and also to extend the water and sewer mains to serve� said <br /> property. <br /> 10. Concurrently with the application to improve the property located at <br /> 3737 Laurel Way, the then owner of 3741 Laurel Way sought similar entitlements <br /> which, if granted, would have provided variances to permit construction of a <br /> residence on that property, subject to conditions similar to that pertaining to 3737 <br /> Laurel Way. The City Council denied that request. <br /> 11. In 1988, as the resutt of then pending applications for further <br /> development of properties fronting on Laurel Way, a report was submitted to the <br /> City Council describing the demand for development and concerns of City Staff <br /> regarding such development without adequate study (Report to Honorable Mayor <br /> and City Council from City Manager, dated September 1, 1988, Subject: <br /> Extension of Development on Laurel Way). On September 12, 1988, by <br /> consensus, the City Council concluded that soils and geologic conditions <br /> regarding further development on Laurel Way require that an Environmental <br /> Impact Report ("EIR") must first be prepared (the "1988 Policy"), in order to <br /> determine the environmental effect of development of the remaining <br /> undeveloped parcels of property on Laurel Way so that cumulative impacts of <br /> development would be assessed in accordance with the California <br /> Environmental Quality Act (Pub. Resources Code 21000, et seq., "CEQA"). <br /> 12. In 1996, upon appeal from the denial by the Zoning Administrator <br /> of an application for variances to the Zon. Ord. to construct a residence at 3741 <br /> Laurel Way, this Council affirmed said denial, consistent with and in partial <br /> reliance upon, the 1988 Policy established by the City Council. <br /> 13. In 1992, an architectural permit and a planned development permit <br /> were issued for the reconstruction of an existing residence damaged by the <br /> Loma Prieta earthquake in 1989, located at 3726 Laurel Way. The parcel of <br /> undeveloped property located between appellants' Property and 3726 Laurel <br /> Way (designated by Assessor's Parcel No. ["APN"] 053-301-230 and hereinafter <br /> so identified) is under the same ownership as 3726 Laurel Way. <br /> 14.
