"The property owner shall enter into an agreement with the <br /> City of Redwood City to pay his share of any future costs for <br /> improvements to Laurel Way. These improvements shall include, <br /> but not be limited to: curb, gutter, sidewalk, replacing [sic] walls, . <br /> pavement, storm drain and sewer system, street lighting, pavement <br /> markings and striping. The applicant [owner] shall also participate <br /> in any future assessment district or similar arrangement which may <br /> be established by the City and/or property owners to pay for the <br /> above improvements by the City through the preparation of an <br /> environmental impact report." <br /> 15. The physical conditions of the terrain, the frontage on the privately- <br /> owned extension of Laurel Way, availability of utilities, and other aspects <br /> pertaining to development of the Property are substantially similar to those <br /> pertaining to 3726 Laurel Way and (intervening) APN 053-301-230. <br /> 16. The Property, the adjoining APN 053-301-230, and the improved <br /> parcel at 3726 Laurel Way all front on that partially improved portion of Laurel <br /> Way which can be improved and widened without performing major grading and <br /> construction of retaining walls, as indicated on those improvement plans <br /> entitled, "Laurel Way Improvement Unit No. 2," dated 9/13R1, prepared in <br /> connection with the above-mentioned assessment district proceedings, and on <br /> file in the offices of the City Engineer. Additionally, the aforementioned three <br /> parcels have access to water and sewer utilities located within Laurel Way. <br /> 17. The 1988 Policy did not clearly distinguish befinreen parcels fronting <br /> on the paved (privately owned) southerly extension of Laurel Way, upon which <br /> the Property, 3726 Laurel Way and APN 053-301-230 front, and other parcels <br /> fronting on the narrower, unpaved southerly and westerly extension. <br /> , 18. The above-described physical conditions pertaining to the Property, <br /> 3726 Laurel Way and the commonly-owned adjoining APN 053-301-230 are <br /> such that the requirement for the owners of said parcels to participate in the <br /> preparation of an area-wide environmental impact report would pose an <br /> unnecessary burden upon the development of such property, disproportionate to <br /> the benefits anticipated to be derived from such EIR. <br /> 19. Appellants and the owner of 3726 Laurel Way and APN 053-301-230 <br /> should not be required to contribute toward the preparation of an area-wide EIR <br /> or participate in an assessment district for the construction of improvements to <br /> Fndgs-5 <br /> f/sh/sh/RC/Council/findings <br /> .. _ _.. <br />
