<br />DES:djg-c <br />S:djg~c <br />DES:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />Ü'2/15/83R <br />07/29/83R <br />11/20/83R <br />12/08/83R <br /> <br />from the appearance of the Leased Premises and remaining <br /> <br />improvements. <br /> <br />(b) <br /> <br />Surfaces. <br /> <br />Lessee shall at its own cost and expense <br /> <br />repair and maintain the surface of the Leased Premises in as good <br /> <br />condition as exists upon the commencement of this lease, ordinary <br /> <br />wear and tear thereto excepted, and subject to such grading, <br /> <br />excavation and improvement thereto as shall be permitted by Lessor <br /> <br />pursuant to the provision of paragraph 7 hereof. <br /> <br />(c) <br /> <br />Failure to Repair. <br /> <br />Should Lessee fail to make, or to <br /> <br />commence diligently to make, any repairs or perform the <br /> <br />maintenance for which it is responsible under the terms hereof <br /> <br />within thirty (30) days after receipt of written notice from Lessor <br /> <br />to make such repairs or to perform such maintenance, Lessor shall <br /> <br />have the option to make and perform such repairs or maintenance <br /> <br />and Lessee agrees to reimburse Lessor for the reasonable cost <br /> <br />thereof within thirty (30) days after receipt of written request <br /> <br />therefor. <br /> <br />(d) <br /> <br />Appearance. <br /> <br />Lessee agrees to provide proper containers <br /> <br />for trash and to keep the Leased Premises and the surface of the <br /> <br />Wharf Facilities <br /> <br />(or any alternate wharf facility which Lessor <br /> <br />permits Lessee to use) during the use and occupancy by Lessee <br /> <br />thereof, and adjoining land and water areas, free and clear of <br /> <br />rubbish, debris, litter, and spills at all times. <br /> <br />Lessee further <br /> <br />agrees to keep and maintain the land area underlying the water <br /> <br />13 <br /> <br />"r--.- ......~....,..._........... <br />
