<br />DES:djg-c <br />r ':djg-c <br />DbS:.djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />02/15183R <br />07/29/83R <br />11/20/83R <br />12/08/83R <br /> <br />berthing area adjacent to the Wharf Facilities, or any alternate <br />docking facility, free and clear of debris from vessels and cargo <br /> <br />handling operations on the wharf or aboard vessels berthed adjacent <br /> <br />to the Wharf Facilities or such alternate docking facility, when <br /> <br />used and occupied by Lessee. <br /> <br />(e) <br /> <br />Safety. <br /> <br />All fire protection sprinkler systems, foam <br /> <br />systems, fire hydrant systems, standpipe systems, fire alarm <br /> <br />systems, portable fire extinquisher and other fire protective <br /> <br />or extinquishing systems or appliances which have been or may <br /> <br />be installed on the Leased Premises shall be maintained by <br /> <br />Lessee in an operative condition at all times. <br /> <br />Similarly, all <br /> <br />booms, arms, floats, and other oil spill, oil slick, or other <br /> <br />water pollution control, collection, or removal devices and <br /> <br />appurtenances kept or maintained by Lessee with respect to the <br /> <br />use and occupancy of the Leased Premises or the Wharf Facilities <br /> <br />shall be kept and maintained by Lessee in an operative condition <br /> <br />at all times. <br /> <br />9. <br /> <br />DAMAGE OR DESTRUCTION. <br /> <br />If Lessee's improvements on the <br /> <br />Leased Premises are damaged or destroyed in whole or in part at any <br /> <br />time or from time to time during the term hereof to the extent that <br /> <br />the cost of repairing, restoring or replacing them exceeds <br /> <br />$2,000,000 then Lessee shall have the option of continuing this <br /> <br />lease agreement (subject to Lessor's right of termination <br /> <br />hereinafter provided) or terminating said agreement. <br /> <br />In the event <br /> <br />14 <br />
