S:djg7c <br />ù~S:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />02/15!83R <br />07/29/83R <br />11/20/83R <br />12/08/83R <br /> <br />Lessee elects to continue this lease agreement, Lessee shall not be <br /> <br />deemed in default hereunder by reason of Lessee's failure to <br /> <br />repair, restore or replace said improvements so long as Lessee <br /> <br />shall not be in default with respect to any other material <br /> <br />provision of this lease to be observed or performed by Lessee <br /> <br />including, but not limited to, Lessee's obligations to pay rent <br /> <br />pursuant to paragraph 3(a) or 3(b), or Minimum Annual Guaranteed <br /> <br />Tariff pursuant to paragraph 4(b) or 4(c), as the case may be. <br /> <br />If Lessee exercises its option above described of terminating <br /> <br />this lease in the event of damage or destruction to Lessee's <br /> <br />improvements as above described, Lessee shall give written notice <br /> <br />thereof to Lessor within three (3) years from the date of <br /> <br />occurrence of such damage or destruction, which termination shall <br /> <br />take effect 90 days after the giving of such notice. <br /> <br />In the event <br /> <br />of termination by Lessee, Lessee shall pay to Lessor an amount <br /> <br />equal to the cash value of the sum of the monthly rental <br /> <br />installments then in effect plus the sum of the monthly <br /> <br />installments of Minimum Annual Guaranteed Tariff then in effect for <br /> <br />the balance of the term after the date of termination, each <br /> <br />discounted by ten (10) percent. <br /> <br />If, within three (3) years of the occurrence of such damage or <br /> <br />destruction above described Lessee does not either (i) commence and <br /> <br />diligently pursue repairing, restoring, or replacing said <br /> <br />improvements, or (ii) give notice of termination to Lessor, Lessor <br /> <br />15 <br />
