<br />DES:djg-c <br />: 3:djg-c <br />DßS:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />0'2/15/83R <br />07/29/83R <br />11/20/83R <br />l2/08/83R <br /> <br />Revenue and Taxation Code Section 107.6, Lessee hereby <br /> <br />acknowledges that this lease agreement may create a possessory <br /> <br />interest subject to property taxation and that Lessee may be <br />subject to the payment of property taxes levied on such interest. <br /> <br />Nothing herein contained shall require Lessee to pay any <br /> <br />imposition of any kind or nature levied or imposed by any tax or <br /> <br />assessment - levying body, if any, imposed upon Lessor or other <br /> <br />owner of the fee of the Leased Premises, or upon rent as such, <br /> <br />payable by Lessee under this lease. <br /> <br />Lessee shall be privileged to seek a reduction in the <br /> <br />valuation of the possessory interest in, or valuation of, the <br /> <br />Leased Premises for tax purposes and to contest in good faith by <br /> <br />appropriate proceedings, at Lessee's expense, the amount or <br /> <br />validity in whole or in part of any imposition. <br /> <br />Lessee shall be <br /> <br />entitled to a refund of any imposition and penalties or interest <br /> <br />thereon received by Lessor which have been paid by Lessee or which <br /> <br />have been paid by Lessor but previously reimbursed in full by <br /> <br />Lessee. <br /> <br />12. <br /> <br />ESTOPPEL CERTIFICATES. <br /> <br />Lessor shall at any time and from <br /> <br />time to time, within 10 days after request by Lessee or a lease- <br /> <br />hold mortgagee or pledgee, certify by written instrument to the <br /> <br />effect that this lease unmodified is in full force and effect (or <br /> <br />if there shall have been modifications, that the same is in full <br /> <br />force and effect as modified and stating the modifications) and the <br /> <br />17 <br /> <br />............~_.
