<br />DES:djg-c <br /><:S:djg~c <br />uES:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />0 2 / 15./ 8 3 R <br />07/29/83R <br />11/20/83R <br />12/0B/83R <br /> <br />27. <br /> <br />TERMINATION FOR GOVERNMENT USE. <br /> <br />In the event the United <br /> <br />States of America, the State of California, or any agency or <br />instrumentality of said governments other than the City of Redwood <br /> <br />City shall, by condemnation or otherwise, take title, possession <br /> <br />or the rights to possession of the Leased Premises, or any part <br /> <br />thereof, and, if in Lessee's opinion, the taking has substantially <br /> <br />impaired the utility of the Leased Premises to Lessee, Lessee may, <br /> <br />at its option, terminate this lease agreement as of the date of <br /> <br />such taking, and all further obligations of the parties shall end, <br /> <br />except as to liabilities which shall theretofore have accrued, and <br /> <br />except for allocation of the proceeds of such taking, as provided <br /> <br />below. <br /> <br />If only a part is taken and the taking of that part does not, <br /> <br />in Lessee's opinion, substantially impair the. utility of the Leased <br /> <br />Premises to Lessee and Lessee does not exercise its aforesaid <br /> <br />option to terminate this lease agreement, Lessee shall continue to <br /> <br />be bound by the terms, covenants and conditions of this lease <br /> <br />agreement; provided, however, the rental payable pursuant to <br /> <br />paragraph 3(a) or 3(b) <br /> <br />(but not the Minimum Annual Guaranteed <br /> <br />Tariff specified in paragraph 4(a) and 4(b) hereof) shall be <br /> <br />reduced in proportion to the relationship that the value of the <br /> <br />portion of the Leased Premises taken bears to the value of the <br /> <br />whole of said premises as of the date possession of the part taken <br /> <br />by the public entity. <br /> <br />34 <br /> <br />. ...--.-....--.,........- ....- .... <br />
