'S : dj g~c <br />l.JBS:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />O.2/15!83R <br />07/29/83R <br />11/20/83R <br />12/08/83R <br /> <br />In the event Lessee believes the taking may be temporary in <br /> <br />nature, it may notify Lessor of that fact prior to the taking <br /> <br />becoming final. <br /> <br />If such notification is given, Lessee shall have <br /> <br />the right to re-let the Leased Premises from Lessor upon the <br /> <br />expiration of the taking upon such terms and conditions as would <br /> <br />be in effect if Lessee's occupancy had not been interrupted by such <br /> <br />temporary taking. <br /> <br />The proceeds from such taking shall be divided by the Lessor <br /> <br />and Lessee in accordance with the laws of California as they exist <br /> <br />at the time of the taking. <br /> <br />If the taking is accomplished by <br /> <br />agreement rather than court decree, such agreement shall specify <br /> <br />how the proceeds will be divided between the parties. <br /> <br />Any dispute <br /> <br />between the parties with respect to the proper division of the <br /> <br />proceeds between them shall be submitted to arbitration as provided <br /> <br />in paragraph 32. <br /> <br />28. <br /> <br />TERMINATION BY COURT DECREE. <br /> <br />In the event any court <br /> <br />having jurisdiction in the matter shall render a decision which <br /> <br />has become final and not subject to appeal and which will prevent <br /> <br />the performance by either party of any of its obligations under <br /> <br />this lease agreement, then either party hereto may terminate this <br /> <br />lease agreement by written notice, and all rights and obligations <br /> <br />hereunder (with the exception of any undischarged rights and <br /> <br />obligations that accrued prior to the effective date of <br /> <br />termination) shall thereupon terminate. <br /> <br />35 <br /> <br />'," <br /> <br />._~""T'-- . <br />
