However, there is cost <br />avoidance to the City in not performing the root cutting per site and the not performing the <br />necessary revisions to the title documents creating the sidewalk maintenance easements <br />which require expensive title searches and deed revisions, and time consuming <br />notarization. The trees will experience less root disturbance with the rubber sidewalk <br />installation than root cutting and concrete installation and this is better for the trees. <br /> <br />Change Order No.2, in the amount of $56,000 will incorporate the use of rubber sidewalks <br />at locations that are not recommended for root pruning due to the tree's condition or <br />species of tree present or where easements cannot be secured to allow adequate space <br />for root cutting. Previously, staff used asphalt in these applications. There are <br />approximately 29 sites on Ohio Avenue of 50 total tree sites where root pruning will not be <br />performed on Evergreen Chinese Elms for tree preservation. <br /> <br />JJR Construction has been certified as an installer by the rubber sidewalk manufacturer. <br />Their unit price has been negotiated for the intended work. <br /> <br />Chanqe Order No.3: Prior to JJR Construction beginning the pre-determined Tree <br />Preservation and Sidewalk Repair Program, the City experienced delays in the Cost <br />Shared Sidewalk Repair Project due to the contractor defaulting on the project. The City <br />subsequently annulled the contract and awarded the remaining work to the second lowest <br />bidder. There was a substantial delay between the annulment of the contract, the award to <br />the second lowest bidder, and the second bidder's ability to begin the work. <br /> <br />In the interim delay period, JJR Construction agreed to assist the City by completing <br />property owner-paid locations at the Tree "reservation and Sidewalk Repair Program <br />contract unit prices. JJR Construction's v. 'ingness to complete these committed but <br />unfinished sites allowed previously paid cost shared repairs to be completed up to 90 days <br />earlier than would have otherwise occurred. <br /> <br />Change order No.3 to the Tree Preservation and Sidewalk Repair Contract is in the <br />amount of $142,413.00 and includes $112,027.50 of cost shared repair sites completed by <br />JJR Construction prior to beginning the Tree Preservation and Sidewalk Repair Program. <br />This change order will facilitate completion of the originally planned project within the <br />neighborhood bordered by Massachusetts, Woodside Road, and Alameda de las Pulgas. <br /> <br />The approval of Change Order No.3 is within the 25% Change Order amount allowed by <br />the project specifications. JJR Construction has agreed to perform the additional work at <br />the existing contract unit prices. <br /> <br />In summary, the Council has previously approved the scope of work included in Change <br />Order No.3, as well as the budget to support the work. While no additiona funds are <br />being spent, JJR's contract cap must be increased by the Council so that staff can now <br />give direction to complete the unfinished portion of the Tree Preservation and Sidewalk <br />Repair Program. <br /> <br />Alternatives <br />Alternatives to approving the change order include: <br />.
