D. Seaport Centre Maintenance District — District Confirmation and Levying <br />of Assessments — Engineering File No. 807 -05 <br />Supervising Civil Engineer Lynch stated that the tally of the votes was done at <br />4:45 p.m. resulting in a 100% vote in favor of the assessment. <br />Mayor Ira opened the public hearing. There was no public comment. <br />M/S Bain /Aguirre to close the public hearing. The motion passed by a <br />unanimous voice vote by those present with Council Member Howard <br />absent. <br />Recommendation: <br />M/S Foust/Pierce to adopt a resolution confirming the City Manager's and <br />Engineer's Reports and ordering the levying of assessments, in accordance with <br />the City Manager's and Engineer's Reports. (507). <br />RESOLUTION 14659 DECLARING TABULATION OF VOTES UPON THE QUESTION <br />OF APPROVAL OF ASSESSMENTS; FINDING THAT NO MAJORITY PROTEST HAS <br />BEEN MADE TO THE LEVY OF ASSESSMENTS; CONFIRMING CITY MANAGER'S <br />AND ENGINEER'S REPORTS AND ORDERING SPECIAL BENEFIT ASSESSMENT <br />TO BE LEVIED AND COLLECTED - SEAPORT CENTRE MAINTENANCE DISTRICT <br />The motion passed by a unanimous voice vote by those present with <br />Council Member Howard absent. <br />9. MATTERS OF COUNCIL INTEREST <br />A. Legislation (information only) — This sub - section involves possible discussion <br />of City Position on Proposed Legislation described in the League of California <br />Cities Priority Focus Bulletin No. 25 -2005 and 26 -2005. Council may direct staff <br />to act on positions taken by Council.
