8.C. - Page 3
Proposed changes to Section 15 and 47d amend existing procedures for publication of
ordinances adopted by the City and Port, respectively. Currently these sections require,
among other things, that the full text of ordinances be published in the City's "official
newspaper." As noted above, the City is unable to comply with these requirements.
Moreover, newspapers are unable to publish the full text of lengthier ordinances in their
print edition. Even if a newspaper were able to print the full ordinance, the cost to the
City would be prohibitive, especially in the case of those lengthier ordinances.
The proposed amendments to Section 15 replace these impracticable requirements with
a requirement to publish ordinances at least once in accordance with procedures
established by an ordinance of the Council. Similarly, with respect to the Port, the
proposed amendments to Section 47d, replace the requirement to publish ordinances in
the official newspaper with a requirement to publish in accordance with procedures
established by an ordinance of the Board of Port Commissioners. These amendments
will give the Council and the Board of Port Commissioners latitude to adopt procedures
that are most effective in reaching members of the public. It will also allow each body to
update publication procedures as technology and media evolve without needing to
amend the Charter.
2) Term Limits for Boards and Commissions
The Committee recommends amendments to Section 17 (Planning Commission),
Section 18 (Library Board), 21'/2 (Establishment of Boards and Commissions), 47b
(Organization: Terms of Office). These proposed amendments establish term limits for
all boards and commissions. Where the current Charter does not impose term limits on
these boards and commissions, the proposed amendments will limit the number of
consecutive terms members can serve to four. These limits mirror the existing term
limits for City Councilmembers set forth in Section 9a of the Charter.
The amendments establish the following with respect to the term limits:
A. Partial terms to which a person is appointed to fill a vacancy on any board or
commission shall not be included in computing consecutive terms.
B. The full term during which a member may resign shall be included in the same
manner as if no resignation had taken place.
C. If a member is not reappointed after serving one or more terms, such member
may be appointed in a later appointment cycle and shall be eligible to serve four
consecutive terms from the date of the later appointment.
D. Full terms or partial terms served prior to January 1, 2019 shall be included in
terms of computing consecutive terms.
