Commission finds that the proposed subdivision, together with the provisions for its <br />design and improvement, is consistent with the general plan as set forth in the staff <br />report. <br />Section 5. Downtown Planned Community permit DPC2017-03: The <br />Planning Commission finds that: <br />a. The project and improvements proposed by Downtown Planned <br />Community permit DPC2017-03 are consistent with, conform to <br />the intent of, and will appropriately implement the Downtown <br />Precise Plan for the 707 Bradford St. project; and <br />b. The establishment, maintenance and operation of the project and <br />improvements proposed by Downtown Planned Community <br />permit DPC2017-03 will not, under the circumstances of this <br />particular case, be detrimental to the public health, safety, peace, <br />morals, or general welfare of persons residing or working in the <br />neighborhood of the project, or be detrimental or injurious to <br />property or improvements in the neighborhood of the project, or <br />to the general welfare of the City, because the project has been <br />found to be consistent with the community goals established in <br />the City's General Plan and Zoning Ordinance; and <br />c. The parking concession is consistent with the State Density Bonus <br />law, and the Project and improvements comply fully with all <br />applicable standards of the DTPP; and <br />d. The Project and improvements comply with all but seven (7) <br />guidelines of the DTPP. The aspects of the Project which do not <br />conform to the guidelines of the DTPP (which are recommended, <br />not mandatory) nonetheless adequately promote the overall intent <br />of the DTPP. <br />Section 6. Density Bonus Parking Concession: The Planning <br />Commission finds that: <br />The concession or incentive results in identifiable and actual <br />cost reductions, consistent with subdivision (k) of Section <br />65915, to provide for affordable housing costs, as defined in <br />Section 50052.5 of the Health and Safety Code, or for rents for <br />the targeted units to be set as specified in subdivision (c) of <br />Section 65915. <br />b. The concession or incentive would not have a specific, adverse <br />impact, as defined in paragraph (2) of subdivision (d) of Section <br />ATN/RESO.0107/PC RESO APPROVING DOWNTOWN PLAN COMMUNITY PERMIT -707 BRADFORD <br />REV: 12-01-17 PR <br />Page 5 of 23 <br />
