4. Dates and Times: The Cinco de Mayo Festivities shall be held on
<br /> Sunday, May 2, 1993 from 10 AM to 7 PM, with set-up beginning at 6
<br /> PM on May 1, 1993. Take down will be on May 2, 1993 with the parking
<br /> lots and Hamilton Street completely clear by 10:00 PM, May 2, 1993.
<br /> 5. Liquor Sales: Sales of beer and wine, in cups, will be allowed until
<br /> 6:00 PM on the day of the Cinco de Mayo Festivities.
<br /> 6. Insurance. Permittee shall furnish to the City public liability and
<br /> property damage insurance naming the City of Redwood City, its Council,
<br /> boards, commissions, officers, employees, and agents as insureds, or
<br /> additional insureds, insuring the same against all claims for personal
<br /> injury or death to any person or persons resulting or arising from the
<br /> conducting of the activities herein permitted, or alleged to have resulted
<br /> or alleged to have arisen therefrom, or from any act or omission to act, of
<br /> Permittee in connection therewith, in the amounts of $500,000 for each
<br /> person and $1,000,000 for each occurrence, and property damage
<br /> insurance for damage or injury to, or destruction of property, including the
<br /> loss of use thereof, in the amount of $500,000. Evidence of such
<br /> insurance coverage in form satisfactory to the City shall be furnished by
<br /> Permittee to the City prior to commencement of the event.
<br /> 7. Damage to Public Property. Permittee shall reimburse the City for
<br /> the costs for any damages to City owned property in the vicinity of the
<br /> designated route, caused by or arising out of, the conducting of the event
<br /> permitted hereunder, or the acts, or omissions to act, of persons
<br /> participating in said event. All signs or other markings placed in or upon
<br /> public property, including the public right-of-way in connection with said
<br /> event shall be removed immediately following said event.
<br /> 8. Compliance With Laws. Permittee shall comply with all appropriate
<br /> rules, regulations and laws applicable to any and all activities which are
<br /> part of, or associated with said Cinco de Mayo Festivities. This permit
<br /> shall be in addition to all other permits which are or may be required for
<br /> conducting said Cinco de Mayo Festivities, or any activity associated
<br /> therewith . Specifically, Permittee shall obtain necessary State ABC
<br /> permits and County health permits.
<br /> 9. Hold Harmless. Permittee shall assume the defense of and indemnify
<br /> and save harmless the City of Redwood City, its Council, officers, boards,
<br /> commissions, employees and agents from all suits, actions, damages, or
<br /> claims to which the City may be subjected of any kind or nature
<br /> whatsoever, resulting from or arising out of the performance or failure to
<br /> perform of Permittee hereunder, or otherwise arising from or arising out
<br /> of said Cinco de Mayo Festivities, or any activities herein permitted.
