ATTY/ORD.449/ORDINANCE AMENDING MUNICIPAL CODE 72 HOUR & COMMERCIAL VEHICLE <br />REV: 11-14-17 MI <br />Page 2 of 4 <br />WHEREAS, oversized commercial vehicles take up valuable parking spaces on <br />City streets and make it difficult for drivers to see other drivers, bicyclists, and pedestrians; <br />and <br />WHEREAS, the City desires to limit parking of oversized commercial vehicles. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br /> Section 2. The proposed Ordinance Amendment is not a project within the <br />meaning of section 15378 of the CEQA Guidelines because it has no potential for <br />resulting in physical change in the environment, either directly or ultimately. In the event <br />that this Ordinance is found to be a project under CEQA, it is subject to the CEQA <br />exemption contained in CEQA Guidelines section 15061(b)(3) because it can be seen <br />with certainty to have no possibility of a significant effect on the environment. <br /> <br />Section 3. If any section, subsection, clause or phrase of this Ordinance <br />Amendment is for any reason held to be invalid, such decision shall not affect the validity <br />of the remaining portion or sections of the Ordinance. The City Council of the City of <br />Redwood City hereby declares that it would have adopted the Ordinance and each <br />section, subsection, sentence, clause or phrase thereof irrespective of the fact that any <br />one or more sections, subsections, sentences, clauses or phrases be declared <br />unconstitutional. <br />Section 4. The City Council hereby adopts the Ordinance Amendment by adding <br />the text shown in underline (example) and deleting the text shown in strikeout (example), <br />as provided below. Wording in brackets ([example]) is informational only and is not to be <br />included in the published ordinance. <br />Section 5. Section 20.95 of Chapter 20, Article VII, Division 1 of the Redwood City <br />Municipal Code is hereby amended to read as follows: <br />Sec. 20.95. - PARKING FOR MORE THAN SEVENTY-TWO CONSECUTIVE HOURS <br />PROHIBITED; REMOVAL BY POLICE: <br />A. No person who owns or has possession, custody, or control of any vehicle shall <br />park or leave standing such vehicle upon a street, alley, or highway, or a parking <br />lot owned or leased by, or under vehicular regulatory jurisdiction of, the City for <br />more than a consecutive period of seventy-two (72) hours. <br />B. In the event a vehicle is parked or left standing upon a street, alley, or highway, or <br />a parking lot owned or leased by, or under vehicular regulatory jurisdiction of, the <br />City in excess of a consecutive period of seventy-two (72) hours, any member of <br />the Police Department authorized by the Chief of Police may remove the vehicle <br />6.4.A. - Page 8
