4124101 Review by the Architectural Review Committee on the Consent Calendar. <br /> The applicant proposes to make a minor change in the building since the <br /> approval was received on February 27, 2001. The modification is approved. <br /> <br />5/01-12/01 Staff and the Opfers met between 8-10 times to negotiate the terms of the <br /> DA. <br /> <br />1/15/02 The Planning Commission reviewed the DA and the details of the project, and <br /> voted unanimously to recommend it to the City Council. The Planning <br /> Commission minutes on this item are attached. <br /> <br />The following sections describe the major elements of the DA. <br /> <br />Term <br />The DA has a total 5-year term, with the requirement that construction must be <br />'substantially commenced' by the second anniversary date; and that construction must be <br />'substantially completed' by the third anniversary. The owners indicated agreement with <br />this term when the issue came before the Planning Commission on January 15, 2002. <br /> <br />Fees and Exactions <br />Exhibit E to the Development Agreement defines the off-site improvements required of the <br />owner, and the fees in-lieu of installing these improvements. There was extensive dialogue <br />between the owner and City staff on these numbers. The proposed in-lieu fees are the City <br />Engineer's best estimate of the real costs of this work. The Owner retains the latitude to <br />actually install the improvements rather than pay the in-lieu fee. <br /> <br />Based on testimony before the Planning Commission, the Owner believes these proposed <br />in-lieu fees to be too high. At the time of writing the Owner has stated the intention to <br />submit material to the City for inclusion in this staff report. <br /> <br />Standard Improvements <br />There are a variety of off-site improvements that Redwood City requires of every <br />developer, with or without a DA. These are described more precisely in Exhibit E to the <br />DA but in summary form they include: <br /> <br />· Developers are required to make offsite improvements adjacent to the project. The <br /> owner must make improvements to the half of Willow Street adjacent to the property, <br /> including new curb, gutter and sidewalk, storm drains and street trees. <br /> <br />· The City's standard requirement is that developers must underground utility lines <br /> adjacent to the property. The subject parcel has overhead lines on both the Middlefield <br /> and Willow faces of the property. Given the small size of the project, and the fact that <br /> there are no other projects that would underground any other lines in the vicinity of this <br /> site, staff agreed to a fee of $58,134 in lieu of undergrounding power lines adjacent to <br /> <br /> <br />
