<br />1 Materials, Commercial Organic Materials and Plant Materials within thirty (30) days' <br />2 notice from Agency, if Agency determines that their appearance warrants painting. <br />3 <br />4 4) Contractor shall inspect each vehicle daily to ensure <br />5 that all equipment is operating properly. Vehicles which are not operating properly <br />6 shall be removed from service until repaired and operating properly. Contractor shall <br />7 perform all scheduled maintenance functions in accordance with the manufacturer's <br />8 specifications and schedule. Contractor shall keep accurate records of all vehicle <br />9 maintenance, recorded according to date and mileage and shall make such records <br />10 available to Agency upon request. <br />11 <br />12 5) Contractor shall repair, or arrange for the repair of, all <br />13 of its vehicles and equipment for which repairs are needed because of accident, <br />14 breakdown or any other cause so as to maintain all equipment in a safe and operable <br />15 condition. If an item of repair is covered by a warranty, Contractor shall obtain <br />16 warranty performance. Contractor shall maintain accurate records of repair, which <br />17 shall include the date and mileage, nature of repair and the verification by signature of <br />18 a maintenance supervisor that the repair has been properly performed. <br />19 <br />20 6) Contractor shall furnish sufficient equipment to <br />21 provide all service required under this Agreement, including back-up Collection <br />22 vehicles. Contractor shall furnish within thirty (30) days of request to Agency, a written <br />23 inventory of all equipment, including Collection vehicles, used in providing service, <br />24 and shall update the inventory annually. The inventory shall list all equipment by <br />25 manufacturer, ID number, date of acquisition, type, and capacity. <br />26 <br />27 7) Contractor shall arrange to store all vehicles and <br />28 other equipment in safe and secure location(s) in accordance with all applicable zoning <br />29 regulations. <br />30 <br />31 D. Operation. Vehicles shall be operated in compliance with <br />32 Federal, State and local laws and regulations including but not limited to the California <br />33 Vehicle Code, and all applicable safety and local ordinances. Contractor shall not load <br />34 vehicles in excess of the manufacturer's recommendations or limitations imposed by <br />35 state or local weight restrictions on vehicles. <br />36 <br />37 Contractor equipment used for Solid Waste, Recyclable Materials, and <br />38 I'lant Materials services shall be registered with the California Department of Motor <br />39 Vehicles. Equipment shall comply with US EPA noise emission regulations, currently <br />40 codified at 40 CFR Part 205 and other applicable noise control regulations, and shall <br />41 incorporate noise control features throughout the entire vehicle.
