<br /> 1 automobiles owned, leased, hired or borrowed by Contractor. The coverage shall <br /> 2 contain no special limitations on the scope of protection afforded to the Agency, <br /> 3 SBWMA, its officials, employees or volunteers. <br /> 4 <br /> 5 b) Contractor's insurance coverage shall be primary <br /> 6 insurance as respects Agency, SBWMA, their officials, directors, employees and <br /> 7 volunteers. Any insurance or self-insurance maintained by Agency, SBWMA, its <br /> 8 officials, employees, directors, agents or volunteers shall be excess of Contractor's <br /> 9 insurance and shall not contribute with it. <br /> 10 <br /> 11 c) Any failure to comply with reporting provisions of <br /> 12 the policies shall not affect coverage provided to Agency, SBWMA their officials, <br /> 13 employees, directors, agents or volunteers. <br /> 14 <br /> 15 d) Coverage shall state that Contractor's insurance shall <br /> 16 apply separately to each insured against whom claim is made or suit is brought, except <br /> 17 with respect to the limits of the insurer's liability. <br /> 18 <br /> 19 2) Workers' Compensation and Employers Liability Coverage <br /> 20 The insurer shall agree to waive all rights of subrogation against Agency, SBWMA, its <br /> 21 officials, employees, directors, agents and volunteers for losses arising from work <br /> 22 performed by Contractor for Agency. <br /> 23 <br /> 24 3) All Coverages - Each insurance policy required by this <br /> 25 clause shall be endorsed to state that coverage shall not be suspended, voided, canceled <br /> 26 by either party, reduced in coverage or in limits except after thirty (30) days' prior <br /> 27 written notice by certified mail, return receipt requested, has been given to Agency. <br /> 28 <br /> 29 E. Acceptability of Insurers. The insurance policies required by this <br /> 30 Section shall be issued by an insurance Company or companies admitted or approved <br /> 31 non-admitted to do business in the State of California subject to the Authority of the <br /> 32 California Insurance Commissioner and with a rating in the most recent edition of Best's <br /> 33 Insurance Reports of size category VII or larger and a rating classification of A or better. <br /> 34 <br /> 35 F. Verification of Coverage. Contractor shall furnish Agency with <br /> 36 certificates of insurance and with original endorsements affecting coverage required by <br /> 37 this clause. The certificates and endorsements for each insurance policy are to be signed <br /> 38 by a Person authorized by that insurer to bind coverage on its behalf. The certificates <br /> 39 and endorsements are to be on forms provided by or acceptable to Agency and are to be <br /> 40 received and approved by Agency before work commences. Agency reserves the right <br /> 41 to require complete, certified copies of all required insurance policies, at any time. <br /> 42 <br /> 43 G. Subcontractor. Contractor shall include all subcontractors as <br /> 44 insureds under its policies or shall furnish separate certificates and endorsements for <br /> Atty j Agrj2005.022 <br /> 060205 -51- <br />
