4. Personal injury coverages at full policy limits for the following: <br /> a. False arrest, malicious prosecution, willful detention or <br /> imprisonment. <br /> b. Libel, slander, defamation of character. <br /> c. Invasion of privacy, wrongful eviction or wrongful entry. <br /> 5. Products and completed operations coverage. <br /> 6. Blanket written contractual liability. <br /> 7. Employees' non-ownership liability. <br /> In addition to the insurance described above, Developer shall require Wentz <br /> Group to purchase and maintain "All Risk or Special Form" Builder's Risk Insurance on <br /> a replacement cost basis in an amount equal to the full replacement cost of the Project <br /> on a completed value basis, including coverage for 'soft costs' such as design, <br /> engineering and construction management fees. The builder's risk insurance shall <br /> cover all risks of loss, including but not limited to fire; lightning; windstorm; hail, mold <br /> occasioned by construction defect, explosion; riot; riot attending a strike; civil <br /> commotion; smoke damage; damage by vehicles; vandalism and malicious mischief; <br /> theft; collapse; flood; and earthquake, and shall be in a form acceptable to City's Risk <br /> Manager. This insurance shall name the City and Agency, as their interests may <br /> appear, and shall include coverage including, but not limited to all damages or loss to <br /> the work; to appurtenances; to materials and equipment to be used on the Project while <br /> the same are in transit or stored on or off the project site; and/or to construction plant <br /> and temporary structures. <br /> The Builder's Risk insurer shall waive all rights of subrogation against City and <br /> Agency. Buifder's Risk Insurance may have a deductible clause not to exceed <br /> $100,000 for all perils other than earthquake and flood. The Builder's Risk policy shall <br /> provide City and Agency the right to use the Streetscape Improvements without <br /> termination of the policy until acceptance of the Project. <br /> C. Developer shall require each Consultant that is performing Services in <br /> connection with construction of the Streetscape Improvements to maintain the following <br /> minimum insurance: <br /> 18 <br /> 840847v8 33786/0001 <br />
