<br />(d) <br /> <br />Payments. <br /> <br />County shall pay to City the estimated <br /> <br />costs of County's grant eligible capacity rights payable <br /> <br />pursuant to paragraph 4(a) and County's non-grant eligible <br /> <br />capacity rights payable pursuant to paragraph 4(b) within <br /> <br />30 days of the date hereof. <br /> <br />Notwithstanding the foregoing, <br /> <br />upon determination of the actual capital costs of Authority's <br /> <br />treatment plant and the actual amounts represented by RCg <br /> <br />and RCn in paragraphs 4(a) and 4(b), respectively, County <br /> <br />shall, within 30 days of such determination, pay such <br /> <br />additional amounts as may be due, or City shall refund <br /> <br />to County such excess amount as County may have paid based <br /> <br />upon the foregoing estimates. <br /> <br />s. <br /> <br />LIMITATION UPON SERVICE AREA. <br /> <br />The treatment <br /> <br />capacity rights reserved and conveyed to County hereunder <br /> <br />are expressly limited to sewage emanating from properties <br /> <br />situate in the Emerald Lake Hills Area as defined and <br /> <br />described herein as it exists upon the date hereof; <br /> <br />subject, however, to the provisions of paragraph 3(c) <br /> <br />relating to the sale, assignment, leasing, licensing, or <br /> <br />other disposition of County's non-grant eligible capacity <br /> <br />rights. <br /> <br />6. <br /> <br />REDUCTIONS IN AREA. <br /> <br />(a) <br /> <br />Entire Territory. <br /> <br />If at any time while this agreement is in effect the <br /> <br />entire territory within the Emerald Lake Hills Area is <br /> <br />included within a city by reason of annexation, incorporation, <br /> <br />or other reorganization, the entire amount of County's <br /> <br />-12- <br />
