<br />grant eligible capacity rights allocated to County hereunder, <br /> <br />and that portion of County's non-grant eligible capacity rights <br />allocated to and serving lands within the Emerald Lake Hills <br /> <br />Area, shall be deemed allocated to the governmental authority <br /> <br />providing sanitary sewerage service for said Area by reason of <br /> <br />such annexation, incorporation, or other reorganization. <br /> <br />Further, <br /> <br />upon the occurrence of such total territorial annexation, incor- <br /> <br />poration, or other reorganization, the obligations hereof shall <br /> <br />be binding upon, and the benefits shall inure to, County's <br /> <br />successor; provided, however, that if the total territory within <br /> <br />said Area be annexed to City, then this agreement shall terminate, <br /> <br />except as to County's obligation to pay for capacity rights <br /> <br />and otherwise except as to obligations already incurred and not <br /> <br />yet satisfied. <br /> <br />Further, if at the time of the completion of <br /> <br />proceedings for such total territorial annexation, incorporation, <br /> <br />or other reorganization, there remains unallocated and committed <br /> <br />to the use of property any of County's n~n-grant eligible <br /> <br />capacity rights, such residual rights shall be used or disposed <br /> <br />of by County in the manner provided by law and this agreement. <br /> <br />(b) <br /> <br />Partial Reduction. <br /> <br />In the event less than the entire <br /> <br />amount of the territory situate within the Emerald Lake Hills Area <br /> <br />is withdrawn from the territorial jurisdiction of County at any time <br /> <br />while this agreement is in effect, County's grant eligible capacity <br /> <br />rights shall be reduced by that amount, as determined by City or <br /> <br />Authority, which is attributable to the portion <br /> <br />of said Area so <br /> <br />withdrawn, and County's non-grant eligible capacity rights shall, <br /> <br />to the extent, if at all, attributable to said portion of said Area <br /> <br />so withdrawn, likewise be reduced by that amount, as determined <br /> <br />by City or Authority, which is attributable to the portion <br /> <br />-13- <br /> <br />"--"~---""-"'" ---".. <br />
