DES:djk 03/05/92 (019/47) <br /> occupancy and use of the Subject Premises ; subject, however, to <br /> City' s prior approval of the design, plans , and method of <br /> carrying out such construction. Further , Permittee accepts the <br /> Subject Premises and all access thereto in the "as is" condition. <br /> Accordingly , Permittee deems it necessary to facilitate access <br /> to the Subject Premises bY construction of l cel lcaticr.s to, or <br /> remodeling of, adjoining areas or portions of the building of <br /> thich the Subject Premises is a part, such construction shall be <br /> subject to City ' s prior approval in the same manner as pertains <br /> to improvement of the Subject Premises and shall be at <br /> Permittee ' s sole cost and expense. <br /> 5 . MAINTENANCE . Permittee shall maintain said <br /> improvements and the Subject Premises in a state of good repair <br /> and in a neat and attractive condition, free from debris and at <br /> Permittee ' s sole cost and expense . <br /> 6 . MANNER OF CONSTRUCTION. Permittee shall carefully <br /> install and maintain said improvements in such manner as not to <br /> damage, interfere with, or obstruct the use of City' s use and <br /> occupancy of areas adjoining the Subject Premises or otherwise <br /> interfere with City' s use of the building in which the Subject <br /> Premises are located. <br /> If Permittee damages , interferes with, or obstructs City' s <br /> use of such adjoining areas or said building, Permittee shall <br /> bear all costs and expenses thereby incurred by City, its agents, <br /> employees , contractors , or subcontractors in connection with <br /> remedying or repairing such damages , interference or obstruction. <br /> Permittee further acknowledges and agrees that in the event of <br /> 3 <br />
