<br />dA ~ £'~ <br /> <br />morals, comfort, or general welfare of persons residing or working in the <br />neighborhood because the proposed use is temporary and of short duration in <br />nature, will be limited in capacity, and will be subject to City regulation and standards <br />regarding site security, lighting, noise, traffic/circulation, and parking. <br /> <br />2. The establishment and operation of the proposed use will not be detrimental or <br />injurious to property or improvements in the neighborhood because the proposed <br />use will be subject to limitations relating to capacity and hours of operation, the <br />maintenance of clear fire lanes at all times'to ensure emergency vehicle access, will <br />be subject to traffic/circulation controls based on. the judgment of the Police <br />DepartmentlTraffic Engineer, and the tent facility to be constructed at the site will be <br />subject to the standards of the Fire Department. <br /> <br />3. The establishment and operation of the proposed use will not be detrimental or <br />injurious to the general welfare of the City because the proposed use will facilitate a <br />seasonal retail activity in the community that will be of benefit to members of the <br />community and of the region. <br /> <br />CONDITIONS OF APPROVAL (from the September 28,2004 approval): <br /> <br />1. The subject use shall substantially conform to the plans and related information <br />submitted by the applicant (Guy Nicoll) and dated stamped received September 20, <br />2004, for the sales event dates to occur from October 1, 2004 through November 1, <br />2004, for pumpkin sale and from November 15, 2004 through January 5, 2005 on file <br />with Planning Services, except as modified by the conditions contained herein. <br /> <br />2. Any modifications to said approved plans and related information must be submitted <br />to Planning Services for review and approval. Any unauthorized modifications to this <br />Use Permit could result in the revocation of the Use Permit (UP2004-90) and <br />jeopardize the approval of any future Use Permit for said use. <br /> <br />3. The applicant shall report any sales to the State Board of Equalization that the point <br />of sale was within the City of Redwood City. <br /> <br />4. This Use Permit is not transferable to another party and shall be limited to the sales <br />of pumpkins, Christmas tree sales and the sale of related seasonal decorations; any <br />other actiyity or sales not in support (as determined by the City) of said seasonal <br />sales shall require prior approval by the City. <br /> <br />5. The use of live animals is not permitted at any time, and would result in the <br />revocation of this Use Permit (UP2004-90). <br /> <br />6. The applicant shall secure a City business license prior to the commencement of the <br />sales event. <br />
