Course Control: Those portions of the 14th Annual Stanford Treeathlon taking <br />place in the public right-of-way shall occur in a manner and shall be limited to that <br />area designated by the Police Chief. <br />7. Insurance: Permittee shall provide City proof of commercial general liability <br />insurance or self-insurance coverage for any and all activities permitted <br />hereunder in the amount of $1,000,000 per occurrence and $2,000,000 <br />aggregate, naming the City, its City Council, commissions, committees, boards, <br />officers, employees, volunteers and agents (collectively "City -insureds") as <br />insureds or additional insureds. If the City -insureds are covered as additional <br />insureds, the Permittee shall provide endorsements to the policy which shall <br />provide that (i) said insurance shall be primary insurance with respect to the City - <br />insureds, (ii) apply separately to each insured against whom claim is made or suit <br />is brought, except with respect to the limits of the insured's liability (cross liability <br />endorsement), and (iii) name the City -insureds as additional insureds. Permittee <br />shall furnish evidence of such insurance coverage in a form satisfactory to City at <br />least ten (10) days prior to commencement of the event. <br />8. Damaae to Public Pronertv: The Permittee shall reimburse City for costs of any <br />damages to City -owned property in the reasonable vicinity of the designated <br />route, caused by or arising out of the conducting of the 14th Annual Stanford <br />Treeathlon permitted hereunder, or the acts or omissions to act, of persons <br />participating in said event. All signs or other markings placed in or upon public <br />property, including the public right-of-way in connection with the "14th Annual <br />Stanford Treeathlon" shall be removed immediately following said event. <br />9. Compliance With Laws: Permittee shall comply with all appropriate and <br />applicable rules, regulations, and laws in connection with the conducting of said <br />event or any and all activities associated therewith. This permit shall be in <br />addition to all other permits that are or may be required for conducting the 14th <br />Annual Stanford Treeathlon or any associated activity. <br />10. Hold Harmless: Permittee shall assume the defense of and indemnify and save <br />harmless the City, its City Council, officers, boards, commissions, employees, <br />volunteers, and agents from all suits, actions, damages, or claims to which the <br />City may be subjected to, of any kind or nature whatsoever, resulting from or <br />arising out of the performance or failure to perform of Permittee hereunder, or <br />otherwise arising from or arising out of said event or any activities herein <br />permitted. <br />
