<br />REV: 03-16-18 MI <br />ATTY/AGR/2018.054/RECOLOGY OF SAN MATEO <br />Page 47 of 119 <br />Contractor acknowledges that the public education and promotion activities listed are 1857 <br />critical to the success of Agency’s diversion performance relative to the Act and other 1858 <br />State legislation/regulations (such as, but not limited to, AB 341, AB 1594, AB 1826, 1859 <br />SB 1061, and SB 1383). As such, Contractor acknowledges Agency’s rights to the 1860 <br />following: 1861 <br />1. Contractor shall make available to Agency and SBWMA all public educational 1862 <br />materials used by Contractor, which Agency and SBWMA shall approve prior to 1863 <br />their use; 1864 <br />2. Agency and SBWMA shall retain the right to modify, expand, or reduce the 1865 <br />minimum public education requirements; 1866 <br />3. Agency may require Contractor to work with a public education consultant 1867 <br />selected by Agency or the SBWMA; 1868 <br />4. Agency may perform, or request that the SBWMA perform on its behalf, the 1869 <br />public education efforts assigned to the Contractor; and, 1870 <br />5. Agency or SBWMA may provide additional, supplemental public education 1871 <br />materials as it deems appropriate. 1872 <br />I. Reporting Requirements 1873 <br />Contractor shall prepare and submit reports related to its public education activities 1874 <br />as provided in Article 9. 1875 <br />J. Service Notice 1876 <br />Contractor shall periodically prepare and distribute to each Customer a notice listing 1877 <br />Agency-approved Rates for standard Collection services, Agency-approved Charges 1878 <br />for other services, annual Holiday Collection Schedule, and a general summary of 1879 <br />services required under this Agreement to be provided Customers and optional 1880 <br />services which may be furnished by Contractor. Such notice shall be approved by 1881 <br />the Agency prior to distribution. 1882 <br />7.04 COMMERCIAL RECYCLING PROMOTION PROGRAM 1883 <br />A. Commercial Recycling Promotion Program Staff. Contractor shall maintain a 1884 <br />Commercial Recycling promotion program staff that will be primarily responsible for 1885 <br />supporting Commercial, Mixed Use Building, and Multi-Family Dwelling Accounts and 1886 <br />Agency Facilities Recycling-related and Organics-related Collection services. The 1887 <br />Commercial Recycling promotion staff for the SBWMA Service Area shall consist of 1888 <br />Waste Zero Specialists (recycling coordinators), as specified in Attachment O. 1889 <br />Contractor shall notify Agency and SBWMA within ten (10) Business Days if any of 1890 <br />the Waste Zero Specialists resigns or is terminated from employment, and shall use 1891 <br />reasonable good faith efforts to initiate recruitment of the position within thirty (30) 1892 <br />days. 1893 <br />If Contractor has one or more Waste Zero Specialist positions unfilled, as approved 1894 <br />in the Three-Year Recycling Technical Assistance Plan, for more than ninety (90) 1895 <br />Days, Contractor and SBWMA shall meet and confer regarding the reasons for the 1896 <br />difficulty in filling the position(s) and ways to remedy the employment gap. In addition, 1897 <br />Contractor shall reimburse Agency for the cost of each such unfilled position for the 1898 <br />period exceeding ninety (90) Days.
