Upon request, Contractor shall provide 1948 <br />details of waste assessments to Agency or SBWMA. 1949 <br />F. Enclosure Specifications. Contractor shall work with the Agency to develop 1950 <br />standard specifications for Collection Container enclosures at Multi-Family 1951 <br />Residential Complexes, Mixed Use Buildings, and Commercial Premises to ensure 1952 <br />that Container enclosures have adequate space and suitable configuration to allow 1953 <br />the Contractor to safely and efficiently service the Containers. The enclosure 1954 <br />specifications shall require provision of adequate space for Solid Waste, Targeted 1955 <br />Recyclable Materials, and Organic Materials Collection Containers. Contractor 1956 <br />provided the enclosure specifications to the Agency on or before the effective date of 1957 <br />the 2009 Franchise Agreement and shall be required to update these specifications 1958 <br />as frequently as needed or as requested by Agency. 1959 <br />G. Plan Review. Contractor shall review plans for land use or property developments, 1960 <br />upon request of the Agency, to assess the adequacy of Container enclosure space 1961 <br />allowances for Solid Waste, Recyclable Materials, and Organic Materials Collection 1962 <br />Containers and the accessibility of Containers by Collection vehicles. The 1963 <br />Contractor’s review shall be completed by the Contractor within ten (10) Business 1964 <br />Days of request by Agency and receipt of the project design drawings. If site 1965 <br />conditions warrant, the Contractor shall conduct a site visit of the proposed property 1966 <br />to complete its evaluation. The Contractor’s review shall be summarized in a letter 1967 <br />report that states acceptability of the proposed enclosure arrangements or notes 1968 <br />specific changes that are required to comply with the enclosure specification. The 1969 <br />letter report shall be signed by the Person that conducted the review, or designee, on 1970 <br />behalf of the Contractor. This review shall include, but not be limited to: 1971 <br />1. Adequacy of the Container enclosure space to store Containers for the 1972 <br />anticipated volume of Solid Waste, Targeted Recyclable Materials, and Organic 1973 <br />Materials generated by a development of the size and purpose contemplated; 1974 <br />2. Adequacy of Container enclosure space to store Containers for Solid Waste, 1975 <br />Targeted Recyclable Materials, and Organic Materials in a fashion that allows for 1976 <br />the greatest possible diversion of materials; and, 1977 <br />3. Adequacy and accessibility of the Container enclosure space for Contractor to 1978 <br />safely and efficiently service all Containers in the contemplated service locations 1979 <br />taking into account the dimensions of the enclosure space, the access road 1980 <br />dimensions, parking arrangements, pedestrian traffic, change in elevation, other 1981 <br />site considerations, and Collection vehicle capabilities. 1982 <br />H. Reporting. Contractor shall prepare and submit reports related to the Commercial 1983 <br />Recycling promotion program as provided in Article 9. 1984 <br />I. Mandatory Commercial Recycling Assistance to Agency. Contractor shall assist 1985 <br />Agency and SBWMA with implementing, monitoring, and reporting on Commercial, 1986 <br />Mixed Use, and MFD Customers’ compliance with requirements for Recyclable 1987 <br />Materials and Organic Materials diversion under AB 341, AB 1826, or other similar 1988 <br />Applicable Law. Upon Agency’s reasonable request and in accordance with Section 1989 <br />9.09.E, Contractor shall provide Agency with periodic reports on Commercial, Mixed 1990 <br />Use, and MFD Customers that do not appear to be complying with State or local 1991 <br />6.2.B. - Page 62
