Hours of Collection 2209 1. Residential. Residential Solid Waste, Targeted Recyclable Materials, and 2210 Organic Materials (including all such services provided to SFD and Multi-Family 2211 Dwelling Premises) shall be Collected on weekdays (i.e., Monday through 2212 Friday) between 6:00 a.m. and 6:00 p.m. exclusive of Holidays defined in 2213 Attachment A for Collection service. 2214 2. Commercial, Mixed Use, and Agency Facilities. Commercial, Mixed Use, and 2215 Agency Facilities Solid Waste, Targeted Recyclable Materials, and Organic 2216 Materials shall be Collected on weekdays (i.e., Monday through Friday) between 2217 3:00 a.m. and 6:00 p.m. and weekends (i.e., Saturday and Sunday) between 2218 6:00 a.m. and 5:00 p.m., exclusive of Holidays specified in Attachment A for 2219 Collection service. The Agency may restrict or require modifications to hours for 2220 Collection from Commercial Premises, Mixed Use Buildings, and Agency 2221 Facilities to resolve noise Complaints, and, in such case, the Agency Manager 2222 may restrict the allowable operating hours. 2223 3. Commercial, Mixed Use, and Agency Facilities Exception. Collection from 2224 Commercial Premises, Mixed Use Buildings, and Agency Facilities that are two-2225 hundred (200) feet or less from Residential Premises shall only occur between 2226 the hours of 6:00 a.m. and 6:00 p.m., Monday through Saturday and all such 2227 operations shall be in accordance with permissions provided to Contractor by 2228 Agency. The Agency may restrict or require modifications to hours for Collection 2229 from Commercial Premises, Mixed Use Buildings, and Agency Facilities to 2230 resolve noise Complaints, and, in such case, the Agency Manager may restrict 2231 the allowable operating hours. 2232 4. Exception. In the event of an unforeseen circumstance, the Contractor may 2233 Collect materials from Residential Premises, Commercial Premises, Mixed Use 2234 Buildings, or Agency Facilities that are two-hundred (200) feet or less from 2235 Residential Premises between the hours of 3:00 a.m. and 6:00 p.m., Monday 2236 through Saturday, upon prior written approval from the Agency Manager. 2237 5. Local Noise Ordinance. If an Agency ordinance regulating noise limits the hours 2238 of Collection more restrictively than the preceding subsections, the terms of the 2239 ordinance shall govern. 2240 6. Modification. The Collection hours and distances set forth in Sections 8.01.A.3 2241 and 8.01.A.4 may be adjusted by mutual agreement of Agency (acting through 2242 the Agency Manager) and Contractor (acting through its General Manager), 2243 provided that the Collection hours and distances are at all times consistent with 2244 Agency ordinances. 2245 6.2.B. - Page 68
