Contractor shall deliver Containers 2289 <br />and initiate Collection services for a new Customer within five (5) Business Days of 2290 <br />the Customer’s request for service. If an existing Customer requests a change in the 2291 <br />number or size of their Solid Waste, Recyclable Materials, or Organic Materials 2292 <br />Containers and/or frequency of Collection, the Contractor shall deliver additional 2293 <br />Containers and/or remove Containers and shall initiate changes in the Collection 2294 <br />services within five (5) Business Days of the Customer’s request for a change in 2295 <br />service. 2296 <br />D. Separate Collection of Materials and Allocation of Agency Materials. Contractor 2297 <br />shall separately Collect and segregate Solid Waste, Targeted Recyclable Materials, 2298 <br />and Organic Materials from each other and shall not Commingle these materials at 2299 <br />any time during the transportation or delivery of those materials to the Designated 2300 <br />Transfer and Processing Facility. Solid Waste, Targeted Recyclable Materials, and 2301 <br />Organic Materials Collected in the Agency, which are combined with materials 2302 <br />Collected from other SBWMA Member Agencies, shall be allocated by Contractor to 2303 <br />the Agency’s Collection program based on volume or Tonnage using a method 2304 <br />approved by the Agency and SBWMA. Contractor shall not Collect materials from 2305 <br />within Agency in the same Collection vehicles used to provide Collection service to 2306 <br />non-SBWMA Member Agencies, unless provided written approval by Agency. 2307 <br />E. Setout Instructions to Customer. Contractor shall instruct Customers as to any 2308 <br />preparation of Solid Waste, Targeted Recyclable Materials, or Organic Materials and 2309 <br />the proper placement of Containers. If Customers are not adhering to Contractor’s 2310 <br />instructions, Contractor shall notify such Customers in writing. In cases of extreme 2311 <br />or repeated failure to comply with the instructions, Contractor may decline to pick-up 2312 <br />the Targeted Recyclable Materials or Organic Materials provided that Contractor 2313 <br />leaves an adequate number of non-Collection notices on the Container, as 2314 <br />determined by the Agency, indicating the reason for refusing to Collect the material. 2315 <br />Such notices shall also identify the steps Generator must take to recommence 2316 <br />Collection service. 2317 <br />F. Non-Collection Notices. Contractor may choose not to Collect materials for the 2318 <br />following reasons: (i) Source Separated or Targeted Recyclable Materials or Organic 2319 <br />Materials do not comply with the allowable Contamination thresholds; (ii) materials 2320 <br />contain Hazardous Waste; or (iii) the loaded weight of a Container exceeds the 2321 <br />maximum load limit specified by the Cart manufacturer and specified in Attachment 2322 <br />D. In such case, Contractor shall issue non-Collection notices stating the reason(s) 2323 <br />the materials were not Collected. The non-Collection notice shall be affixed 2324 <br />prominently onto the Cart to ensure that it is not inadvertently removed from Cart due 2325 <br />to weather conditions. The non-Collection notices must be protected from rain, if 2326 <br />precipitation is present or forecasted, by placing the notice in a clear plastic bag prior 2327 <br />to affixing to Cart. 2328 <br />Contractor shall document the use of non-Collection notices by recording the date 2329 <br />and time of issuance, address of service recipient, reason(s) for issuance, name of 2330 <br />employee who issued the notice, and truck and route numbers. The notice shall 2331 <br />conform to the requirements specified in Section 6.03.A, be at least two inches by six 2332 <br />inches (2" x 6") in size and shall be approved by the SBWMA. The non-Collection 2333 <br />notices must identify the steps the Generator must take to recommence Collection 2334 <br />service. In the event a Container is not Collected due to excessive Contamination and 2335 <br />Customer does not take the necessary steps to recommence Collection service, 2336 <br />6.2.B. - Page 70
