All personnel furnished by 2746 <br />Contractor shall be subject to the “relationship of parties” provisions of Section 15.01. 2747 <br />B. Reserved. 2748 <br />C. Collective Bargaining Agreements. If Contractor negotiates a new collective 2749 <br />bargaining agreement with a union representing its employees, or an amendment to 2750 <br />a collective bargaining agreement currently in force, either of which increases wages 2751 <br />or benefits greater than wage and benefit costs included in Contractor’s 2752 <br />Compensation (through adjustments described in Article 11 and Attachment K), the 2753 <br />Agency is not required to include costs attributable to the increased wages or benefits 2754 <br />in Contractor’s Compensation during the Term of the Agreement. 2755 <br />D. Approval of Management. Contractor recognizes the importance of establishing a 2756 <br />successful relationship between its management and Agency and SBWMA staff. 2757 <br />Before extending an offer of employment for the position of general manager, both 2758 <br />initially and throughout the Term, Contractor shall provide the SBWMA with the 2759 <br />description of the proposed position; an opportunity to review and comment upon the 2760 <br />position description, the background, experience, and qualifications of each 2761 <br />candidate being considered for the position, and an opportunity to meet with each 2762 <br />candidate. Contractor shall give thoughtful consideration to the SBWMA ’s comments 2763 <br />on the descriptions of the proposed position and each candidate, but shall have the 2764 <br />ultimate right to make employment decisions in its best business judgment. 2765 <br />If the Agency is dissatisfied with the performance of the management personnel, the 2766 <br />Agency shall contact the general manager to discuss the employee’s performance. 2767 <br />If the Agency is dissatisfied with the general manager, the Agency shall contact the 2768 <br />group manager to discuss the general manager’s performance. 2769 <br />Contractor shall advise the affected management employee of any complaints made 2770 <br />by the Agency regarding the employee’s performance. The Parties shall meet and 2771 <br />confer in good faith to address the Agency’s concerns, and shall agree on a corrective 2772 <br />course of action to be implemented immediately. Contractor agrees to consider in 2773 <br />good faith, but shall not be bound by, any requests by the Agency to transfer or re-2774 <br />assign a management employee should the Agency maintain in good faith that it can 2775 <br />no longer work constructively with said employee. 2776 <br />E. Provision of Field Supervision. Contractor shall designate qualified employees as 2777 <br />supervisors of field operations. The field supervisor shall devote their time in the field 2778 <br />supervising, managing, and monitoring Collection operations for reliability, quality, 2779 <br />efficiency, safety, and for responding to Complaints. The number of field supervisors 2780 <br />is specified in Attachment O in total for the SBWMA Service Area. 2781 <br />F. Driver Qualifications. All drivers shall be trained and qualified in the operation of 2782 <br />Collection vehicles, and must have in effect a valid license, of the appropriate class, 2783 <br />issued by the California Department of Motor Vehicles. Contractor shall use the Class 2784 <br />II California Department of Motor Vehicles employer “Pull Notice Program” to monitor 2785 <br />its drivers for safety. 2786 <br />G. Customer Service Representative Training. Customer service representatives 2787 <br />shall be trained on specific Agency service requirements, a minimum of once per 2788 <br />quarter. An Agency information sheet shall be provided to each Customer service 2789 <br />representative for easy reference of Agency requirements and general Customer 2790 <br />6.2.B. - Page 80
